Reflexión sobre la privación de la libertad ante infracciones de adolescentes como un último recurso en el Perú: el caso de la Casación Nº 1721-2019-Piura

Resumen
Con el aumento de la inseguridad y la participación de adolescentes en actos
contrarios a la ley, también aumenta en gravedad la respuesta estatal en su rol
de garante de la seguridad ciudadana. Ello puede verse reflejado en las
propuestas legislativas que se presentan cada tiempo al respecto de la
disminución de edad para la imputabilidad penal, pero también puede reflejarse
en que, sostenidamente, la respuesta de las autoridades judiciales ha sido
apostar por la medida más gravosa para la resolución de estos casos: el
internamiento. Debido a este abordaje de la problemática que rodea a los y las
adolescentes infractores/as, se plantea la pregunta principal: “¿Se emplea la
privación de libertad como medida de último recurso en el sistema de justicia
penal juvenil peruano en concordancia con los fines de la justicia penal juvenil y
un sistema integral de justicia juvenil en el marco de los estándares
internacionales establecidos en la materia?”. Tras la revisión teórica y el
examen de su aplicación práctica en nuestro sistema de justicia penal juvenil,
finalmente se llegarán a cuatro conclusiones puntuales que abordarán los
fundamentos del uso de las medidas privativas de libertad como recursos de
ultima ratio, su correlato en la práctica peruana, y la tres posibles causas de la
disonancia entre la teoría y a la práctica a partir de un caso.
With the increase in insecurity and the participation of adolescents in acts contrary to the law, the state response in its role as guarantor of citizen security also increases in severity. This can be seen reflected in the legislative proposals that are presented every time regarding the reduction of the age for criminal liability, but it can also be reflected in the fact that, consistently, the response of the judicial authorities has been to opt for the most burdensome measure for the resolution of these cases: internment. Due to this approach to the problem surrounding adolescent offenders, the main question is raised: "Is deprivation of liberty used as a measure of last resort in the Peruvian juvenile criminal justice system in accordance with the purposes of juvenile criminal justice and a comprehensive juvenile justice system within the framework of the international standards established on the matter?”. After the theoretical review and the examination of its practical application in our juvenile criminal justice system, four specific conclusions will finally be reached that will address the foundations of the use of custodial measures as ultima ratio resources, their correlation in Peruvian practice, and the three possible causes of the dissonance between theory and practice based on a case.
