Informe jurídico sobre la Resolución 139-2020- SUNARP-TR-T

Abstract

En el Perú, el otorgamiento de poder a terceros para que autoricen el viaje de menores de edad es una práctica común, debido a las diferentes circunstancias que pueden afrontar los padres de familia, en especial aquellos que viven en el extranjero. Al no haber una norma expresa que regule un otorgamiento de poder con dichas características, la calificación registral que se ha hecho de este tipo de actos no ha sido uniforme, lo que ha motivado que sea incluido como punto de agenda dentro de los Plenos 193 y 235 del Tribunal Registral, llevados a cabo en el 2018 y 2020, respectivamente. Los acuerdos adoptados en dichos plenos sostienen interpretaciones significativamente distintas pues el primero exige como requisito para la inscripción del poder que la voluntad del poderdante se encuentre plenamente determinada, mientras que el segundo prescinde de dicho requisito y admite la inscripción del mencionado poder de manera general, a pesar que la regulación vigente al momento de que ambos plenos fueron llevados a cabo era la misma. En el presente informe se analiza la Resolución No. 139-2020-SUNARP-TR-T, que sigue la línea interpretativa del Pleno 193 del Tribunal Registral, por lo que se examinan instituciones como el apoderamiento, patria potestad, orden público, entre otros, a fin de determinar si es inscribible dicho otorgamiento y, de ser el caso, cuáles son sus límites.

In Peru, granting a power of attorney to authorize travel for minors is a common practice due to the different circumstances that parents may face, especially those living abroad. Since there is no express rule governing the granting of a power of attorney with these characteristics, the registry assessment of this type of acts has not been uniform, which has led to its inclusion as an agenda item in the 193rd and 235th Plenary Sessions of the Registry Court, held in 2018 and 2020, respectively. The resolutions adopted at these plenary sessions support significantly different interpretations. In the first plenary session, it was concluded that the grantor's will be fully stated as a requirement for registration of the power of attorney, while the latter waives this requirement and allows registration of the aforementioned power of attorney in a general manner, despite the same regulations in force at the time both plenary sessions were held. This report analyzes Resolution No. 139-2020-SUNARP-TR-T, which follows the interpretative line of Plenary Session 193 of the Registry Court, examining institutions such as power of attorney, parental authority, public order, among others, in order to determine whether such granting is registrable and, if so, what its limits are.
