Resumen
El presente informe tiene como objetivo analizar la Resolución N° 1216-2023-
SUNAFIL/TFL-Primera Sala, con la finalidad de determinar si se configuró un acto de
discriminación laboral en el acceso al empleo, en el caso de un postulante que padecía
de VIH. Para ello, el análisis se enfoca en determinar, en primer lugar, el momento en
que ocurrieron los hechos y, posteriormente, analizar cada una de las acciones de la
empresa para determinar si hubo discriminación, según lo establecido por el Tribunal de
Fiscalización Laboral.
De ese modo, se concluye a favor de lo resuelto por el Tribunal, dado que se identificó
una vulneración al principio de igualdad de trato sin una justificación objetiva y
razonable, constituyendo discriminación hacia el postulante al no continuar con su
proceso de selección tras conocer su diagnóstico de VIH a través de los resultados de
sus exámenes médicos. No obstante, se considera que el Tribunal podría haber llevado
a cabo un análisis más exhaustivo, abordando temas como los exámenes médicos de
pre-empleo o pre-ocupacionales para postulantes, aspectos no regulados en la
normativa vigente, y evaluando el riesgo del puesto de camillero quirúrgico en relación
con estos exámenes, que incluyen la prueba de VIH, para proporcionar una respuesta
más completa al caso.
The purpose of this report is to analyze Resolution No. 1216-2023-SUNAFIL/TFL-First Chamber, in order to determine whether there was an act of labor discrimination in the access to employment, in the case of an applicant with HIV. For this purpose, the analysis focuses on determining, first, the time at which the facts occurred and, subsequently, analyzing each of the company's actions to determine whether there was discrimination, as established by the Labor Inspection Court. Thus, it is concluded in favor of the Court's decision, given that a violation of the principle of equal treatment was identified without an objective and reasonable justification, constituting discrimination against the applicant by not continuing with his selection process after learning of his HIV diagnosis through the results of his medical examinations. However, it is considered that the Court could have carried out a more exhaustive analysis, addressing issues such as pre-employment or pre-occupational medical examinations for applicants, aspects not regulated in the current regulations, and evaluating the risk of the position of surgical orderly in relation to these examinations, which include the HIV test, to provide a more complete response to the case.
