Abstract
En el presente trabajo se analiza una casación emitida por la Sala Civil Transitoria que se aparta de la interpretación realizada por el Tribunal Constitucional al artículo 2014° del Código Civil, la cual resulta de vinculante aplicación a la Corte Suprema. Este análisis busca, a su vez, demostrar que la ineficacia es un supuesto implícito del artículo 2014° del Código Civil, lo que resulta decisivo para resolver algunos casos en la realidad.
This paper analyzes a cassation issued by the Transitory Civil Chamber that departs from the interpretation made by the Constitutional Court to Article 2014° of the Civil Code, which is binding for the Supreme Court. This analysis seeks, in turn, to demonstrate that ineffectiveness is an implicit assumption of article 2014° of the Civil Code, which is decisive to solve some cases.
