Informe jurídico sobre conflicto competencial respecto al control judicial de las decisiones del Congreso STC EXP. N° 0003-2022-CC/TC

Resumen
El presente Informe tiene como finalidad abordar la sentencia del Tribunal
Constitucional mediante la que se declaró fundada la demanda competencial
interpuesta por el Congreso de la República contra el Poder Judicial, por el
presunto menoscabo de atribuciones exclusivas. Para estos efectos, se analizan
tres procesos de amparo en cuyos pronunciamientos judiciales se fundamentó
el petitorio competencial: en primer lugar, el expediente N°03898-2022-0-1801-
JR-DC-03 mediante el que se resolvió suspender el procedimiento de
designación del Defensor del Pueblo; en segundo lugar, el expediente N°00400-
2022-0-0401-JR-DC-01 mediante el que se dispuso el cese de denuncias
constitucionales contra el presidente del Jurado Nacional de Elecciones; y, el
expediente N°00893-2022-0-1801-JR-DC-02 mediante el que se declaró la
nulidad del procedimiento normativo en el que se pretendía modificar la Ley
Universitaria.
El estudio se enfoca en identificar, primero, si en cada caso en concreto nos
encontramos frente a una atribución tutelada por el proceso competencial
(elemento subjetivo y objetivo) para posteriormente determinar si, no obstante
tratarse de una atribución del Congreso, es susceptible de ser controlada
judicialmente. Para ello se invocarán los artículos pertinentes de la Constitución
Política del Perú, la Ley Orgánica de la Defensoría del Pueblo, el Reglamento
del Congreso, el Nuevo Código Procesal Constitucional, la Ley Orgánica del
Jurado Nacional de Elecciones, así como la jurisprudencia constitucional que
corresponda.
Finalmente, expongo las razones por las cuales estoy de acuerdo con lo resuelto
por el TC en el caso de la Defensoría del Pueblo, pero no en el caso del
presidente del JNE y la SUNEDU.
The purpose of this Report is to address the ruling of the Constitutional Court declaring the competence claim filed by the Congress of the Republic against the Judicial Branch, for the alleged infringement of its exclusive powers, to be well founded. For this purpose, three amparo proceedings are analyzed in whose judicial pronouncements the competence petition was based: firstly, file N°03898- 2022-0-1801-JR-DC-03 whereby it was resolved to suspend the procedure for the appointment of the Ombudsman; secondly, file N°00400-2022-0-0401-JR DC-01 whereby it was ordered the cessation of constitutional complaints against the president of the National Jury of Elections; and, file N°00893-2022-0-1801- JR-DC-02 whereby it was declared the nullity of the normative procedure in which it was intended to modify the University Law. The study focuses on identifying, first, whether in each specific case we are faced with an attribution protected by the competence process (subjective and objective element) in order to subsequently determine whether, despite being an attribution of Congress, it is susceptible to judicial control. For this purpose, the pertinent articles of the Political Constitution of Peru, the Organic Law of the Ombudsman's Office, the Regulations of Congress, the New Constitutional Procedural Code, the Organic Law of the National Jury of Elections, as well as the corresponding constitutional jurisprudence will be invoked. Finally, I state the reasons why I agree with the TC's decision in the case of the Ombudsman's Office, but not in the case of the president of the JNE and SUNEDU.
