Resumen
El presente informe jurídico analiza los alcances del deber de información en el
mercado de servicios de transporte aéreo, tomando como referencia la
Resolución N.° 1783-2024/CC2, emitida en el marco de un procedimiento
administrativo sancionador iniciado contra Sky Airline Perú S.A.C. por no
consignar el precio en moneda nacional ni informar el tipo de cambio al momento
de la compra de boletos aéreos a través de su plataforma electrónica. A partir de
este caso, el trabajo tiene por objetivo determinar el alcance del deber de
información respecto a la consignación de precios en moneda nacional y
extranjera, en función de lo dispuesto por los artículos 2° y 6.1° del Código de
Protección y Defensa del Consumidor.
Se sostiene que el deber de información no se aplica de manera uniforme, sino
que debe observarse con un enfoque diferenciado según la etapa de la relación
de consumo. En ese marco, el artículo 6.1° resulta exigible únicamente en la
etapa precontractual, concretamente a los supuestos de publicidad y difusión,
sin que corresponda extender su aplicación a fases posteriores, donde operan
condiciones técnicas y comerciales distintas.
En particular, se examina la estructura real del sector aéreo, caracterizada por la
fijación de tarifas en dólares y la aplicación de tipos de cambio por parte de las
entidades bancarias. A partir de ello, el análisis permite afirmar que el marco
normativo vigente establece parámetros suficientes para garantizar la
transparencia informativa, sin que ello implique trasladar al proveedor
responsabilidades que excedan lo previsto por la ley.
This legal report analyzes the extent of the duty to provide information in the air transport services market, taking as a reference Resolution No. 1783-2024/CC2, issued in the context of administrative proceedings initiated against Sky Airline Peru S.A. C. for failing to state the price in national currency or inform the exchange rate at the time of purchase of airline tickets through its electronic platform. Based on this case, the aim of this paper is to determine the duty to provide information regarding the statement of prices in national and foreign currency, in accordance with the provisions of Articles 2 and 6.1 of the Consumer Protection and Defense Code. It is argued that the duty to provide information does not apply uniformly but must be observed with a differentiated approach depending on the stage of the consumer relationship. In this context, Article 6.1 is enforceable only in the precontractual stage, specifically in cases of advertising and dissemination, without extending its application to subsequent phases where different technical and commercial conditions operate. In particular, the actual structure of the airline industry is examined, characterized by the setting of fares in dollars and the application of exchange rates by banks. Considering this, the analysis allows us to affirm that the current regulatory framework provides sufficient parameters to guarantee transparency of information, without this implying the transfer of responsibilities to the supplier that exceed those provided for by law.
