La Facultad Discrecional de la Policía Nacional en la decisión de los Cambios Generales y la vulneración de los Principios de Motivación de las Resoluciones y de Predictibilidad

Abstract
El objetivo del presente estudio es: Determinar si la facultad discrecional de la Policía
Nacional del Perú en la decisión de cambios generales vulnera los principios de motivación
de resoluciones y predictibilidad. La justificación, se destaca en que, ante la facultad
discrecional, para que la administración pueda tomar decisiones en función a la oportunidad,
la norma faculta a la administración pública otorgándole un margen para que pueda tomar
dichas decisiones. Entre los principios que componen la buena administración, que no solo
es un principio, sino que es un derecho, que otorga un rango distintivo del deber de toda
autoridad de motivar sus decisiones y demostrar y acreditar que dichas decisiones, han sido
adoptadas en forma objetiva y congruente con la finalidad de interés público. En la esfera
metodológica, se utilizó el enfoque cualitativo, asimismo la técnica utilizada, fue el análisis
de la información, que se inició con la recopilación y lectura del material relevante del objeto
de la investigación para concluir con su interpretación. La conclusión principal, consiste en
que se puede afirmar que los cambios o modificaciones que se han realizado en la esfera de
la Policía Nacional del Perú, respecto a las asignaciones de los Oficiales PNP, que se realizan
de manera anual, no se viene realizando acorde al Principio de la Buena Administración, ni
al cumplimiento de los Principios de Motivación de las Resoluciones y el Principio de
Predictibilidad, por ello muchas veces, en los nuevos cambios generales, los profesionales
asignados no son los más idóneos, no se tiene en cuenta la meritocracia, incumpliéndose lo
precisado en el artículo 166 de la Constitución Política, como es la garantía del orden interno.
The objective of this study is: To determine if the discretionary power of the National Police of Peru in the decision of general changes violates the principles of motivation of resolutions and predictability. The justification stands out in that, given the discretionary power, so that the administration can make decisions based on opportunity, the rule empowers the public administration by granting it a margin so that it can make such decisions. Among the principles that make up good administration, which is not only a principle, but also a right, which grants a distinctive range of the duty of all authorities to motivate their decisions and demonstrate and prove that said decisions have been adopted objectively. and consistent with the purpose of public interest. In the methodological sphere, the qualitative approach was used, likewise the technique used was the analysis of the information, which began with the collection and reading of the relevant material of the object of the investigation to conclude with its interpretation. The main conclusion is that it can be affirmed that the changes or modifications that have been made in the sphere of the National Police of Peru, regarding the assignments of the PNP Officers, which are made annually, have not been carried out according to the Principle of Good Administration, nor to compliance with the Principles of Motivation of Resolutions and the Principle of Predictability, for this reason many times, in the new general changes, the professionals assigned are not the most suitable, the meritocracy, failing to comply with the provisions of article 166 of the Political Constitution, such as the guarantee of internal order.
