Publicidad incompleta del acto de cesión de derechos patrimoniales hereditarios: Un análisis de la Resolución N° 580-2022-SUNARPTR-L

Resumen
Mediante Resolución 580-2022-SUNARP-TR-L el Tribunal Registral de Lima ha
reconocido el carácter no inscribible de la cesión de derechos patrimoniales
hereditarios en el Registro de Sucesión Intestada; ya que su inscripción
únicamente tiene lugar en el Registro de Bienes.
El objeto de la cesión de derechos hereditarios es el traslado del derecho de
participación sobre la masa hereditaria, de modo que exigir partida registral sobre
un bien individualizado desnaturaliza el objeto mencionado, y, en consecuencia,
lo que en práctica se está realizando no es nada más que el traslado de dominio
sobre bienes.
Ello genera restricciones al cesionario en el ejercicio de su posición como
acreedor, acceso a las cuentas bancarias, beneficios sociales y a los derechos
patrimoniales por derechos de autor del causante
La presente investigación ofrece una propuesta de interpretación normativa del
Reglamento de Inscripciones de Testamentos y Sucesión Intestada y del
Registro de Predios, a fin de considerarlo como acto inscribible, prescindiendo
de modificación legislativa alguna.
Por todo ello, discrepo con la decisión del Tribunal Registral, toda vez que la
inscripción en el Registro de Bienes excluye de publicidad a las situaciones
jurídicas desvinculadas a los derechos reales.
In resolution 580-2022-SUNARP-TR-L, the Registry Court of Lima has recognized the non-registrable nature of the assignment of hereditary property rights in the Registry of Intestate Succession; since its registration only takes place in the Property Registry. The object of the assignment of hereditary rights is the transfer of the right of participation over the hereditary estate, so that demanding a registry item on an individualized asset distorts the aforementioned object, and, consequently, what is being done in practice is nothing more than the transfer of ownership over assets. This generates restrictions to the assignee in the exercise of his position as a creditor, access to bank accounts, social benefits and economic rights due to copyright of the deceased. The present investigation offers a proposal for the normative interpretation of the Regulation of Registration of Wills and Intestate Succession and of the Land Registry, in order to consider it as a registrable act, regardless of any legislative modification. For all these reasons, I disagree with the decision of the Registry Court, since the registration in the Property Registry excludes legal situations unrelated to real rights from publicity.
