Tutela judicial efectiva y debida diligencia reforzada en las medidas de protección otorgadas por un juzgado especializado del distrito judicial de Ancash a favor de las mujeres víctimas de violencia en el año 2021

Resumen
En este artículo, se trata de establecer si se garantiza la tutela judicial efectiva y
debida diligencia reforzada con las medidas de protección dictadas por un
juzgado especializado del distrito judicial de Ancash, a favor de las mujeres
víctimas de violencia durante el año 2021, para el cual se ha procedido a evaluar
tales principios a la luz de resoluciones que conceden dichas órdenes judiciales,
habiendo llegado a la conclusión de que para anularse, controlarse y disminuir
el riesgo en que se encuentren las mujeres violentadas y permitírseles una vida
libre de violencia, es necesario que las medidas de protección sean idóneas,
integrales, razonables y ejecutables; y, para lograr ese objetivo debe aplicarse
los enfoques basados en los derechos humanos, de género, de
interseccionalidad e interculturalidad, así como juzgar con perspectiva de
género, libre de todo estereotipo sexista y aplicando los métodos legales
feministas, como “la pregunta por la mujer”, que es capaz de revelar
objetivamente la realidad en que se encuentran las mujeres y la desigualdad
entre ellas y los hombres. Además, para alcanzar los estándares universales de
la debida diligencia reforzada es menester que los jueces tanto al impartir como
al realizar el seguimiento y supervisión de las órdenes de protección actúen con
celeridad, seriedad, imparcialidad y exhaustividad, no debiendo intervenir como
si se tratara de una simple formalidad destinada anticipadamente al fracaso,
exigencias que no se vislumbran plenamentede los casos analizados.
This article tries to establish whether effective judicial protection and reinforced due diligence are guaranteed with the protection measures issued by a specialized court of the judicial district of Ancash, in favor of women victims of violence during the year 2021, for the which has proceeded to evaluate such principles in the light of resolutions that grant said judicial orders, having reached the conclusion that to annul, control and reduce the risk in which violated women find themselves and allow them a life free of violence, it is protection measures must be suitable, comprehensive, reasonable and enforceable; and, to achieve this objective, approaches based on human rights, gender, intersectionality and interculturality must be applied, as well as judging with a gender perspective, free of all sexist stereotypes and applying feminist legal methods, such as "the question about the woman”, which is capable of objectively revealing the reality in which women find themselves and the inequality between them and men. In addition, in order to achieve the universal standards of enhanced due diligence, it is necessary that judges, both when issuing and when monitoring and supervising protection orders, act promptly, seriously, impartially, and thoroughly, and should not intervene as if they were a simple formality destined to fail in advance, requirements that cannot be seen in the cases analyzed.
