Resumen
El presente informe tiene como finalidad realizar un análisis sobre los problemas
jurídicos vinculados a la Resolución N° 3266-2022-SUNARP/TR, los cuales se
encuentran relacionados a casos de homonimia y la cancelación de asientos
registrales por la Superintendencia Nacional de los Registros Públicos
(SUNARP).
El Notario Público de Lima, Raúl Fernández Valderrama, solicitó la inscripción
de transferencia de titularidad sobre un bien inmueble a la sucesión intestada de
Victoria Quispe Centeno, la cual fue otorgada por la Registradora Pública, Doris
Valverde Vara Cadillo, posterior a la calificación del título. El problema se origina
cuando la Registradora Pública inscribe el título, dado que la titular registral del
predio y la persona fallecida compartían el mismo nombre – Victoria Quispe
Centeno. A raíz de ello, se solicita la cancelación de la inscripción del asiento
registral de transferencia de titularidad a la sucesión intestada, en virtud de
inexistencia de acto causal en el título inscrito.
Mediante la utilización de métodos analíticos, que forman parte de la revisión de
la legislación aplicable, jurisprudencia y doctrina relacionada a los temas en
controversia en el presente caso, se podrá concluir que se necesitan
implementar mecanismos jurídicos que permitan la obligatoriedad de verificación
de los datos de los intervinientes en los actos jurídicos que los Registradores
Públicos califican a través de los títulos; y que la ausencia de ello permite que se
sigan vulnerando diferentes principios parte de nuestro sistema registral y, en
consecuencia, promueva la incertidumbre jurídica en nuestro ordenamiento
The purpose of this report is to provide an analysis of the legal problems related to Resolution N° 3266-2022-SUNARP/TR, which are related to cases of homonymy and cancellation of registry entries by the National Superintendence of Public Registries (or in its Spanish acronym, SUNARP). The Notary Public of Lima, Raul Fernandez Valderrama, requested the registration of the transfer of ownership of a property to the intestate succession of Victoria Quispe Centeno, which was granted by the Public Registrar, Doris Valverde Vara Cadillo, after the qualification of the title. The problem arose when the Public Registrar registered the title, since the title holder of the property and the deceased person shared the same name - Victoria Quispe Centeno. As a result, the cancellation of the registration of the transfer of ownership to the intestate succession is requested, due to the inexistence of a causal act in the registered title. Through the use of analytical methods, which are part of the review of the applicable regulation, jurisprudence and doctrine related to the issues in controversy in this case, it can be concluded that it is necessary to implement legal mechanisms that allow the mandatory verification of the data of the parties involved in the legal acts that the Public Registrars qualify through the titles; and that the absence of this allows different principles of our registry system to continue to be violated and, consequently, promotes legal uncertainty in our legal system.
