Resumen
El Tribunal Registral es la segunda instancia administrativa que evalúa los títulos
de los administrados que buscan la inscripción de diversos actos y derechos,
pero que han sido observados o tachados por la primera instancia; es decir, por
parte del Registrador Público.
El presente informe versa sobre la Resolución N°115-2005-SUNARP-TR,
mediante el cual el Tribunal Registral realiza una interpretación inédita de los
derechos otorgados por parte de un funcionario público, específicamente un
título emitido por el Director de la Dirección de Capitanías y Guardacostas. El
análisis pretende ser un enfoque crítico al tratamiento realizado respecto a la
figura denominada bloqueo registral y, por otro lado, al análisis realizado por el
Tribunal Registral sobre la naturaleza jurídica del acto contenido en el título y su
posibilidad de acceso al Registro Público. Ello, en la medida que el Tribunal
Registral le cambió la naturaleza jurídica a un acto administrativo y le brindó
acceso al Registro Público de manera arbitraria.
El presente trabajo ha seguido un método descriptivo y analítico en base a las
diversas normas que regulan el tema, así como las recomendaciones surgidas a
partir de entrevistas directas con expertos en la materia.
The Registry Court serves as the second administrative instance responsible for evaluating the titles of individuals seeking registration of various acts and rights that have been observed or crossed out by the first instance, that is, the Public Registrar. This report analyzes Resolution N°115-2005-SUNARP-TR, a legal document issued by the Registry Court that offers an unparalleled interpretation of the rights bestowed upon a public official, particularly those rights associated with a title issued by the Directorate of Captaincy and Coast Guard. The analysis is intended to be a critical approach to the treatment given to the figure known as registry block and, on the other hand, to the analysis made by the Registry Court on the legal nature of the act contained in the title and its possibility of access to the Public Registry. This is evidenced by the Registry Court's alteration of the legal nature of an administrative act and its subsequent arbitrary grant of access to the Public Registry. The present paper has employed a descriptive and analytical method based on the various rules that regulate the subject, as well as the recommendations arising from direct interviews with experts in the field.
