Resumen
El principal problema de investigación es la falta de criterio vinculante en las
decisiones de las autoridades administrativas para la aprobación del cese
colectivo, particularmente en el caso materia de investigación sobre la causal
económica.
Ello debido a que dicha causal es recurrente en las solicitudes presentadas por
las empresas, pues indican encontrarse en una crisis económica, por lo que
consideran que el cese colectivo es la mejor opción para evitar una próxima
quiebra.
Por consiguiente, en el presente trabajo se analizarán las deficiencias que
contiene la normativa sobre cese colectivo dispuesto en el artículo 48 de la LPCL
a fin de emitir conclusiones que arriben a una mejora de dicha normativa.
The main research problem is the lack of binding criteria in the decisions of the administrative authorities for the approval of the collective dismissal, particularly in the case of investigation on the economic grounds. This is due to the fact that said cause is recurrent in the applications presented by the companies, since they indicate that they are in an economic crisis, for which they consider that the collective dismissal is the best option to avoid an upcoming bankruptcy. Therefore, in the present work the deficiencies contained in the regulations on collective dismissal provided in article 48 of the LPCL will be analyzed in order to issue conclusions that lead to an improvement of said regulations.
