Resumen
El siguiente informe pretende analizar el Pleno de Sentencia N° 423/2023,
emitido en razón del Exp N° 00882-2023-PA/TC que contiene la disputa entre
Ricardo Moran Vargas, en representación de los menos E.M. y C.M. y el Registro
Nacional de Identificación y Estado Civil (Reniec).
El problema del caso surge a raíz de la solicitud de inscripción extemporánea de
los menores E.M y C.M. presentada por Ricardo Moran Vargas ante Reniec para
que estos sean inscritos como ciudadanos peruanos. Dicha solicitud fue
presentada por Moran Vargas únicamente consignando sus apellidos (Moran
Vargas) como apellidos de los menores, en tanto estos fueron concebidos
mediante maternidad subrogada y no se “conoce” la identidad de la madre.
Reniec en respuesta la solicitud emite las Resoluciones 109-2021-
ORSBORJJR10LIM-GOB/RENIEC y 110-2021-ORSBORJ-JR10LIMGOB/
RENIEC denegando el pedido de inscripción de ambos menores de edad
justificando que ello contravenía lo dispuesto en los artículos 20 y 21 del Código
Civil. La impugnación de esta denegatoria por parte de Moran Vargas escaló
hasta el Tribunal Constitucional.
El presente informe pretende realizar una propuesta de interpretación a los
artículos 20 y 21 del Código Civil con la finalidad de que estos permitan
responder no solo a casos como el presente si no también a la realidad
cambiante de nuestra sociedad sin representar un supuesto de discriminación y
asegurando la mayor satisfacción de los derechos fundamentales de los
menores de edad.
The following report intends to analyze the Plenary Judgment No. 423/2023, issued on account of Exp N° 00882-2023-PA/TC containing the dispute between Ricardo Moran Vargas, on behalf of the minors E.M. and C.M. and the National Registry of Identification and Civil Status (Reniec). The problem of the case arises from the request for extemporaneous registration of minors E.M. and C.M. filed by Ricardo Moran Vargas before Reniec so that they may be registered as Peruvian citizens. Said request was filed by Moran Vargas only including his surname (Moran Vargas) as the surname of the children, since they were conceived through surrogate motherhood and the identity of the mother is not "known". Reniec, in response to the request, issued Resolutions 109-2021- ORSBORJJR10LIM-GOB/RENIEC and 110-2021-ORSBORJ-JR10LIMGOB/ RENIEC denying the request for the registration of both minors, justifying that this contravened the provisions of articles 20 and 21 of the Civil Code. The challenge of this denial by Moran Vargas escalated to the Constitutional Court. The present report intends to make a proposal for the interpretation of articles 20 and 21 of the Civil Code with the purpose of allowing them to respond not only to cases such as the present one but also to the changing reality of our society without representing a case of discrimination and ensuring the greatest satisfaction of the fundamental rights of minors.
