Resumen
En el presente artículo se busca analizar la pieza publicitaria del producto "Maggi
Cubito de Carne de 100g" a partir de la siguiente pregunta: ¿constituye dicha
pieza publicitaria un acto de competencia desleal en la modalidad de engaño?
Para responder a esta cuestión, será necesario abordar la siguiente interrogante:
¿debe la frase "Mezcla deshidratada sabor carne", que figura en la parte frontal
del producto, ser considerada parte de la publicidad, a pesar de estar incluida en
el rotulado registrado ante la Dirección General de Salud Ambiental (“DIGESA”)?
Para delimitar el mensaje publicitario, será esencial llevar a cabo un análisis tanto
superficial como integral de la publicidad de empaque del producto. Este análisis
debe realizarse conforme al artículo 21 del Decreto Legislativo N.º 1044 - Ley de
Represión de la Competencia Desleal (“LRCD”), con el objetivo de determinar la
interpretación que el destinatario (consumidor) tendría de la publicidad sin
requerir un análisis exhaustivo ni razonado. Este enfoque debe basarse en la
experiencia general de consumo en el mercado de productos saborizantes. De
esta forma, se podrá evaluar si la Sala Especializada en Defensa de la
Competencia realizó un análisis adecuado de la pieza publicitaria y si esta
constituye o no un acto de competencia desleal en la modalidad de engaño,
según lo regulado en el artículo 8 de la LRCD.
This article seeks to analyze the advertising piece of the product "Maggi Cubito de Carne de 100g" based on the following question: does such advertising constitute an act of unfair competition in the form of deception? In order to answer this question, it will be necessary to approach the following question: should the phrase "Meat flavor dehydrated mixture", which appears on the front of the product, be considered part of the advertising, despite being included in the labeling registered before DIGESA? In order to delimit the advertising message, it will be essential to carry out a superficial as well as an integral analysis of the product packaging advertising. This analysis must be carried out in accordance with Article 21 of Legislative Decree No. 1044 - Law for the Repression of Unfair Competition ("LRUC"), with the objective of determining the interpretation that the addressee (consumer) would have of the advertising without requiring an exhaustive and reasoned analysis. This approach should be based on the general consumer experience in the market for flavoring products. In this way, it will be possible to evaluate whether or not the Specialized Antitrust Court conducted an adequate analysis of the advertising piece and whether or not it constitutes an act of unfair competition in the form of deception, as regulated in article 8 of the LRUC.
