Abstract
La presente investigación se enmarca en el derecho ambiental y administrativo,
y analiza la Resolución N.° 023-2024-ANA-TNRCH, a través de la cual se
determinó la responsabilidad solidaria a la Municipalidad Provincial de Huancayo
y Municipalidad Distrital de Chilca por la ocupación de la faja marginal izquierda
del río Mantaro sin autorización de la Autoridad Nacional del Agua para la
disposición final de residuos sólidos.
La ocupación no autorizada del bien asociado al agua, tal como la faja marginal,
para la disposición de residuos sólidos municipales evidencia la comisión una
infracción normativa con distintos niveles de intervención con posibles
consecuencias ambientales, lo que genera la interrogante sobre la idoneidad de
aplicar una sanción solidaria a las entidades ediles. Se discute la omisión de
deberes por parte de la Autoridad Nacional del Agua, así como la falta de
coordinación interinstitucional.
Desde una perspectiva jurídica crítica, se propone que la responsabilidad
administrativa debería ser individualizada, a fin de respetar los principios de
legalidad y proporcionalidad, y asegurar una mejor prevención del daño
ambiental. Finalmente, se concluye que la disposición inadecuada de residuos
en fajas marginales configura una afectación grave al ecosistema fluvial y pone
en evidencia debilidades estructurales en la gobernanza ambiental local.
This research is framed within environmental and administrative law and analyzes Resolution No. 023-2024-ANA-TNRCH, which established joint liability for the Provincial Municipality of Huancayo and the District Municipality of Chilca due to the unauthorized occupation of the left faja marginal of the Mantaro River for the final disposal of solid waste, without prior authorization from the National Water Authority (ANA). The unauthorized use of this water-associated public domain asset for the disposal of municipal solid waste constitutes a regulatory infringement, carried out with differing levels of institutional involvement and potential environmental consequences. This raises questions regarding the appropriateness of imposing joint sanctions on the involved municipal entities. The report also examines the omission of legal duties by the National Water Authority and the lack of effective interinstitutional coordination. From a critical legal perspective, the study argues that administrative liability should be individualized, in order to uphold the principles of legality and proportionality, and to ensure more effective prevention of environmental harm. Ultimately, it concludes that the improper disposal of solid waste in riparian zones constitutes a serious impact on the fluvial ecosystem and reveals structural deficiencies in local environmental governance.
