Resumen
Las decisiones del Tribunal Constitucional del Perú sobre sanciones disciplinarias, en contextos militares, generan importantes debates constitucionales. Por ello, el presente informe jurídico busca analizar la sentencia del Tribunal Constitucional recaída en el Expediente N.º 04580-2023-PA/TC, que declaró infundada la demanda de amparo de K.A.V.A., alumno de la academia militar de la FAP, contra la Resolución Directoral 0090-DIGPE que dispuso su baja definitiva por mantener actos sexuales (sexo oral) en instalaciones militares, siendo su problema jurídico principal determinar si fue constitucional o no dicha resolución.
En base al análisis de los problemas secundarios derivados del principal, se dará una respuesta sobre la constitucionalidad de dicha resolución. En primer lugar, se determinará si la sanción impuesta constituye una restricción razonable y proporcional al derecho al libre desarrollo de la personalidad. En segundo lugar, se analizará si durante el procedimiento disciplinario se respetaron las garantías del debido proceso y el derecho a la intimidad, con énfasis en la licitud de la prueba utilizada (video íntimo obtenido por un tercero anónimo). Finalmente, se evaluará si el Tribunal Constitucional debió otorgar mayor relevancia, a la sentencia favorable dictada previamente a L.S.C.R. en un caso idéntico, considerando el principio de igualdad y no discriminación. La metodología del presente informe jurídico se basa en el análisis de doctrina especializada y de jurisprudencia nacional sobre derechos fundamentales, debido proceso, derecho a la intimidad, derecho a la defensa, derecho al libre desarrollo de la personalidad y control del poder disciplinario en contextos institucionales militares.
The decisions of the Peruvian Constitutional Court on disciplinary sanctions in military contexts generate important constitutional debates. Therefore, this legal report seeks to analyze the Constitutional Court's rulingin Case No. 04580-2023-PA/TC, which declared unfounded the amparo claim of K.A.V.A., a student at the FAP military academy, against Directorial Resolution 0090-DIGPE which ordered his permanent discharge for engaging in sexual acts (oral sex) in military installations. The main legal issue is to determine whether or not that resolution was constitutional. Based on the analysis of the secondary issues arising from the main issue, a response will be provided regarding the constitutionality of said resolution. First, it will be determined whether the sanction imposed constitutes a reasonable and proportional restriction on the right to the free development of personality. Secondly, we will analyze whether due process guarantees and the right to privacy were respected during the disciplinary proceedings, with emphasis on the legality of the evidence used (an intimate video obtained by ananonymous third party). Finally, we will assess whether the Constitutional Court should have given greater weight to the ruling previously issued in favor of L.S.C.R. in an identical case, considering the principles of equality and non-discrimination. The methodology of this legal report is based on an analysis of specialized doctrine and national jurisprudence on fundamental rights, due process, the right to privacy, the right to defense, the right to free development of personality, and the control of disciplinary power in military institutional contexts.
