Resumen
En la zona fluvial, especialmente en Iquitos, los titulares de embarcaderos no
cumplen con la normativa portuaria, debido a que en el diseño del procedimiento
administrativo de Viabilidad Técnica Temporal Portuaria no se ha aplicado
adecuadamente el análisis de calidad regulatoria, obstaculizando que el
administrado pueda continuar con los demás procedimientos administrativos hasta
obtener la licencia portuaria, que otorga la autorización para la operación de la
instalación portuaria.
El examen del mencionado procedimiento administrativo a partir de los principios
de necesidad, de efectividad y de proporcionalidad del análisis de la calidad
regulatoria (excepto el principio de legalidad, dado que, la Autoridad Portuaria
Nacional es la única entidad competente para otorgar las vialidades técnicas a los
proyectos portuarios) nos permite advertir que en la selva es necesaria una
regulación diferenciada que tenga en consideración la realidad de la zona fluvial.
La informalidad en la zona fluvial pone en riesgo a la población, toda vez que los
embarcaderos informales no cumplen con las medidas de protección y de seguridad,
debido a que son desarrollados por personal que no cuenta con conocimientos
básicos para brindar los servicios y las actividades portuarias con estándares de
calidad idóneos; produciéndose accidentes que han cobrado vidas humanas y pone
en riesgo la vida los pobladores.
In the fluvial zone, especially in Iquitos, the wharf holders do not comply with the port regulations, due to the fact that the regulatory quality analysis has not been adequately applied in the design of the administrative process of Temporary Technical Viability, making it difficult for the manager to be able to continue with the other administrative process until obtaining the port license, which grants authorization for the operation of the port facility. The examination of the aforementioned administrative process based on the principles of necessity, effectiveness and proportionality of the regulatory quality analysis (except the principle of legality, since the National Port Authority is the only competent entity to grant technical roads to port projects) allows us to warn that in the jungle a differentiated regulation is necessary that takes into account the reality of the fluvial zone. Informality in the river zone puts the population at risk, since the informal piers do not comply with the protection and security measures, because they are developed by personnel who do not have basic knowledge to provide the services and activities. port facilities with suitable quality standards; causing accidents that have claimed human lives and puts the lives of the inhabitants at risk.
