Abstract
La discriminación en el consumo es un concepto reciente en la normativa
nacional e internacional. Este fenómeno afecta el derecho a la igualdad de las personas y
su dignidad, y es por este motivo que este acto ilícito debe ser sancionado y repudiado
por los Estados. Debido a que es un concepto nuevo, los consumidores no tienen muy en
claro cuándo se constituye una discriminación en el consumo y tienden a confundirla con
otras figuras, muy similares, que se establecen dentro del derecho del consumidor, como
es el caso del trato ilícito diferenciado. En el presente trabajo de investigación
desarrollaremos cómo nació la figura de discriminación en el consumo en nuestra
normativa nacional. Asimismo, el presente trabajo tiene por finalidad desarrollar el
concepto de discriminación en el consumo y trato ilícito diferenciado para poder
demostrar que ambos conceptos no son iguales. De igual manera, para poder demostrar
que existe una diferencia entre ambos conceptos analizaremos algunas resoluciones y
sentencias emitidas por Indecopi y el Tribunal Constitucional. Por último,
desarrollaremos nuestra teoría llamada “Teoría del tipo infractor en el consumo”,
mediante la cual se demostrará que existen dos tipos infractores que tienen el mismo
resultado: la vulneración del derecho a la igualdad, pero la diferencia se encontrará en el
motivo que hay detrás de cada acción.
Discrimination in consumption is a recent concept in national and international regulation. This phenomenon affects the equality right and dignity of people, and it is for this reason that this illegal act must be punished and repudiated by the States. Because it is a new concept, consumers are not very clear when it constitutes a discrimination in consumption and tend to confuse it with other figures, very similar, that are established within the law of the consumer as it is: differentiated illicit treatment. In this research work we will develop how the figure of discrimination in consumption was born in our national regulations. Likewise, the purpose of this work is to develop the concept of discrimination in consumption and differentiated illicit treatment in order to demonstrate that both concepts are not the same. Similarly, in order to demonstrate that there is a difference between both concepts, we will analyze some of the resolutions and sentences issued by Indecopi and the Constitutional Court. Finally, we will develop our theory called “Theory of the offending type in consumption”, through which it will be shown that there are two offending types that have the same result: the violation of the right to equality, but the difference will be found in the reason that behind every action.
