Resumen
El presente trabajo académico analiza tres problemas jurídicos que han sido identificados en la
Casación N° 49 – 2019 Ayacucho. El primer problema es referente a establecer cuál es el bien
jurídico general y específico del delito de negociación incompatible en base a las propuestas
establecidas por la doctrina y la jurisprudencia peruana. Luego de esbozar un concepto del bien
jurídico y su finalidad del mismo, la autora propone una interpretación constitucional del bien
jurídico que permitirá comprender el artículo 399 del código penal. De otra parte, el segundo
problema jurídico que se aborda se centra en la aplicación de la connotación económica del
interés indebido y si este debe ser únicamente patrimonial. Al respecto la autora concuerda con
lo señalado con la casación en análisis para establecer que este, no es un requisito. Finalmente,
se desarrolla una diferenciación entre los delitos de peligro abstracto y concreto, para concluir
que el delito de negociación incompatible es uno de peligro abstracto.
This academic work analyzes three legal problems that have been identified in Cassation No. 49 - 2019 Ayacucho. The first problem is related to establishing what is the general and specific legal interest of the crime of incompatible negotiation based on the proposals established by the Peruvian doctrine and jurisprudence. After outlining a concept of the legal interest and its purpose, the author proposes a constitutional interpretation of the legal interest that may include article 399 of the penal code. On the other hand, the second legal problem addressed focuses on the application of the economic connotation of undue interest and whether it should be solely patrimonial. In this regard, the author agrees with what was indicated with the cassation under analysis to establish that this is not a requirement. Finally, a differentiation between the crimes of abstract and concrete danger is developed, to conclude that the crime of incompatible negotiation is one of abstract danger.
