Abstract
En el presente informe jurídico, se realizará una crítica al análisis realizado en la
Resolución Nº 00695-2022-TCE-S3 por el Tribunal de Contrataciones con el
Estado que haciendo uso de su potestad sancionadora resolvió determinar la
configuración de la infracción de la presentación de información inexacta e
impuso una sanción hacia los administrados. Así, dicha crítica partirá de la
importancia de poder establecer cuáles son los elementos del tipo infractor según
la ley aplicable, de acuerdo al principio de retroactividad benigna. Para después,
poder analizar correctamente la configuración de la subsunción de todos los
elementos de la infracción administrativa, sin tomar en consideración
interpretaciones extensivas que vayan en contra del principio de tipicidad.
Todo ello terminara evidenciando la existencia de variaciones en el tiempo del
tipo infractor analizado en el presente informe, debido a las múltiples
modificaciones que se han realizado en la normativa de las contrataciones con
el estado en el Perú. En particular, respecto al elemento que la información
inexacta debe estar relacionada con la obtención una ventaja o beneficio en favor
del administrado, pues de no existir en la disposición normativa pasó a
convertirse en un elemento individual señalado taxativamente, que puede
terminar decretando la configuración o no del tipo infractor.
This legal report critiques the analysis carried out in Resolution No. 00695-2022- TCE-S3 by the State Contracting Tribunal, which, exercising its sanctioning authority, decided to determine the nature of the infraction of the submission of inaccurate information and imposed a sanction on the parties. This critique will be based on the importance of establishing the elements of the type of infraction under the applicable law, in accordance with the principle of benign retroactivity. This will then allow for a correct analysis of the subsumption of all the elements of the administrative infraction, without taking into account broad interpretations that run counter to the principle of typification. All of this will ultimately reveal the existence of variations over time in the type of infraction analyzed in this report, due to the multiple modifications that have been made to the regulations on state contracting in Peru. In particular, regarding the element that the inaccurate information must be related to obtaining an advantage or benefit in favor of the administrator, since if it did not exist in the regulatory provision, it became an individual element specifically indicated, which may end up decreeing the configuration or not of the type of infraction.
