Abstract
EL caso Atala Riffo y niñas vs. Chile constituye un hito en materia de igualdad y no
discriminación, al ser la primera vez que en el Sistema Interamericano de Derechos
Humanos se reconoce la orientación sexual como categoría protegida por la Convención
Americana sobre Derechos Humanos. Sin embargo, este fallo presenta una serie de
omisiones en el reconocimiento de la vulneración de dos derechos en específicos: el
derecho a la no discriminación por razón de genero y el derecho a la garantía de
imparcialidad. En el presente caso, se buscará determinar la existencia de dichas
violaciones mediante un análisis crítico.
The case of Atala Riffo and girls vs. Chile is a milestone in terms of equality and nondiscrimination, as it is the first time that the Inter-American Human Rights System recognizes sexual orientation as a category protected by the American Convention on Human Rights. However, this ruling presents a series of omissions in the recognition of the violation of two specific rights: the right to non-discrimination based on gender and the right to guarantee impartiality. In the present case, the existence of said violations will be determined through a critical analysis.
