Resumen
El presente informe jurídico se centra en constatar si es adecuada la posición
que asumen las Salas Civiles de la Corte Suprema en los casos de
reconocimiento de unión de hecho ante consorte fallecido, teniendo como
objeto el análisis del que se presenta en la Casación N° 4416-2018 Puno.
Para alcanzar dicho propósito se parte del análisis de categorías jurídicas como
la carga de la prueba, las cargas dinámicas probatorias y la valoración de la
prueba, siempre en el marco del proceso judicial de reconocimiento de unión
de hecho.
Asimismo, se formulan otras tres cuestiones relevantes, cuyo análisis otorga
mayor sustento a nuestra cuestión principal detallada en el primer párrafo; para
lo cual, nos apoyamos en las reglas jurídicas del Código Procesal Civil y del
Código Civil como norma sustantiva, además del siempre necesario soporte en
la jurisprudencia de los tribunales de cierre y en las fuentes doctrinarias más
especializadas.
Finalmente, al culmino del presente informe jurídico, llegamos a la conclusión
de que la Sala Civil Permanente de la Corte Suprema de Justicia de la
República mantiene una posición tradicional y bastante conservadora respecto
de la carga de la prueba en los procesos de reconocimiento judicial de unión de
hecho ante consorte fallecido. Razón por la cual se hace precisión en las
cargas dinámicas probatorias y su eventual uso en cuanto se apruebe el
Proyecto del Nuevo Código Procesal Civil.
This legal report focuses on verifying whether the position assumed by the Supreme Court in cases of recognition of partnership of the marriage when one spouse has deceased, with the purpose of analyzing the one presented in Cassation No. 4416-2018 Puno. To achieve this purpose, it is based on the analysis of the legal categories of the burden of proof, the dynamic loads probative and the assessment of the evidence, always within the framework of the judicial process of recognition of partnership of the marriage. Likewise, three other relevant questions are formulated, whose analysis gives greater support to our main question detailed in the first paragraph; for which, we rely on the legal rules of the Civil Procedure Code and the Civil Code as a substantive rule, in addition to the always necessary support in the jurisprudence of the high courts and in the most specialized doctrinal sources. Finally, at the end of this legal report, we came to the conclusion that the Main Civil Chamber of the Supreme Court of Justice maintains a traditional and quite conservative position regarding the burden of proof in judicial recognition processes of partnership of the marriage when one spouse has deceased. Reason for which precision is made in the dynamic loads probative and their eventual use as soon as the Project of the New Civil Procedure Code is approved.
