Resumen
El presente informe de suficiencia profesional se basa en la sentencia de la Corte
IDH sobre el caso Olivera Fuentes vs Perú. En dicha decisión, se declaró la
responsabilidad internacional del Estado por la violación de los derechos a la
vida privada, garantías judiciales, igualdad ante la ley y protección judicial en
perjuicio del señor Olivera Fuentes. Esta vulneración se produjo debido a las
respuestas administrativas y judiciales brindadas por las autoridades frente a la
denuncia interpuesta por el peticionario, alegando que fue discriminado en la
cafetería de un supermercado debido a su orientación sexual.
El problema principal analizado en el trabajo consiste en determinar la
responsabilidad internacional del Estado por la vulneración de derechos del
peticionario. A partir de ello, se examina si es que el Estado es responsable por
la comisión de actos de discriminación cometidos por particulares,
específicamente por la empresa de supermercado que llevó a cabo el acto de
discriminación. Asimismo, se analizan los alcances de la vulneración de los
derechos a la vida privada, igualdad ante la ley y libre desarrollo de la
personalidad en relación a la orientación sexual del peticionario y la prohibición
de discriminación.
Finalmente, se evalúan los alcances de la inversión de la carga de la prueba en
la relación de consumo que existía entre la empresa y el cliente para determinar
el acto de discriminación en la cafetería. Ello se realiza como parte del análisis
planteado para los derechos a la protección judicial y garantías judiciales del
demandante.
The present professional sufficiency report is based on the judgment issued by the Inter-American Court of Human Rights in the case of Olivera Fuentes vs. Peru. In said ruling, the international responsibility of the State was declared for the violation of Mr. Olivera Fuentes' rights to privacy, judicial guarantees, equality before the law, and judicial protection. This violation occurred as a result of the administrative and judicial responses provided by the authorities in response to the petitioner's complaint, alleging discrimination in a supermarket cafeteria due to his sexual orientation. The main issue addressed in this report is to determine the State's international responsibility for the petitioner's rights violation. As such, an examination is conducted to ascertain whether the State bears responsibility for acts of discrimination committed by private individuals, specifically by the supermarket company that engaged in the discriminatory act. Furthermore, an analysis is conducted on the extent of the violation of rights to privacy, equality before the law, and the free development of personality with regard to the petitioner's sexual orientation and the prohibition of discrimination. Finally, an evaluation is made of the implications of the burden of proof reversal in the consumer relationship between the company and the client, aimed at determining the act of discrimination in the cafeteria. This assessment is undertaken as part of the analysis proposed for the petitioner's rights to judicial protection and judicial guarantees.
