Resumen
En el presente informe se analizará la sentencia de la Corte Interamericana de
Derechos Humanos en el caso Duque vs. Colombia. De esta forma, se buscará
llegar a una conclusión sobre la responsabilidad del Estado colombiano por la
vulneración del principio de igualdad y no discriminación, y el derecho a la
integridad, en perjuicio de Ángel Duque. Para ello, se empleará normativa
nacional respecto a la regulación colombiana sobre parejas del mismo sexo,
así como normativa internacional sobre la protección de los derechos humanos.
Asimismo, se examinará la jurisprudencia de la Corte Constitucional posterior y
si con ello se puso fin a la vulneración de los derechos del señor Duque o si, a
pesar de ello, es necesario que se declare la responsabilidad constitucional del
Estado. De igual forma, se verá si los establecimientos de salud públicos
garantizan una atención de calidad a las personas con VIH/SIDA, en
comparación a un seguro social. Con ello, se pretende llegar la conclusión de
que Colombia es responsable por la vulneración de los derechos humanos
contemplados en la Convención Americana; por tanto, tiene la obligación de
subsanar el daño causado y garantizar que una situación similar o igual vuelva
a darse dentro de su territorio.
This report will analyze the judgment of the Inter-American Court of Human Rights in the Duque vs. Colombia case. In this way, it will seek to conclude on the responsibility of the Colombian State for the violation of the tenet of equality and non-discrimination, and the right to integrity, to the detriment of Angel Duque. For this, national regulations will be used regarding Colombian law on same-sex couples, as well as international regulations on the protection of human rights. In addition, the jurisprudence of the subsequent Constitutional Court will be examined and if this put an end to the violation of the rights of Mr Duque or if it´s necessary to declare the constitutional responsibility of the State. In the same way, it will be seen if public health establishments guarantee quality care for people with HIV/AIDS, compared to social security. With this, it is intended to conclude that Colombia is responsible for the violation of the human rights contemplated in the American Convention; therefore, it must rectify the damage caused and guarantee that a similar or the same situation occurs again within its territory.
