Abstract

El presente texto analiza la controversia entre Andean Telecom Partners y la Municipalidad Distrital de San Borja recaída en el Expediente N°000200-2019/CEB con el objetivo de analizar el pronunciamiento y fundamentos esgrimidos en primera y segunda instancia administrativa por el Indecopi. Con miras a ello, se abordó la revisión del expediente administrativo, jurisprudencia administrativa, doctrina especializada en la materia, el régimen legal aplicable en el tiempo de los hechos y el marco normativo vigente. Los resultados evidencian que el Indecopi debió iniciar un procedimiento administrativo sancionador (en adelante, PAS) en contra de la entidad municipal. Asimismo, se pone de manifiesto que no se realizó un análisis adecuado sobre determinados aspectos clave que hubieran contribuido a una mayor solidez del razonamiento expuesto. Ello permite concluir que las decisiones emitidas por el Indecopi en el caso en concreto pudieron tutelar los intereses de los administrados, en el marco del procedimiento de eliminación de barreras burocráticas, de manera más adecuada. Finalmente, el texto ofrece mayor profundidad sobre los problemas jurídicos que plantea la controversia, así como una propuesta de modificación del Decreto Legislativo N°1256.

This text analyzes the controversy between Andean Telecom Partners and the District Municipality of San Borja in Case No. 000200-2019/CEB with the purpose of analyzing the pronouncement and grounds presented in the first and second administrative instance by Indecopi. In order to do so, a review of the documents comprising the administrative file, administrative jurisprudence, specialized doctrine on the matter, the regulatory framework applicable at the time of the facts and the regulatory framework in force was undertaken. The results show that Indecopi should have initiated an administrative sanctioning procedure against the municipal entity. Likewise, it is evident that an adequate analysis of certain key aspects that would have contributed to a more solid reasoning was not carried out. This leads to the conclusion that the decisions issued by Indecopi in the case in question could have protected the interests of the parties involved, within the framework of the procedure for the elimination of bureaucratic barriers, in a more adequate manner. Finally, the text offers more depth on the legal problems raised by the controversy, as well as a proposal to amend Legislative Decree No. 1256.
