Resumen
El presente informe jurídico tiene como finalidad realizar un análisis de los problemas
jurídicos encontrados en la Sentencia del Tribunal Constitucional Exp. N° 00655-
2010PHC/TC, la cual establece que las interceptaciones telefónicas realizadas a Alberto
Quimper constituían prueba prohibida y que los medios de comunicación se encontraban
prohibidos de divulgar o difundir interceptaciones y grabaciones de conversaciones
telefónicas, sin autorización previa. En ese sentido, para comprender los problemas
planteados y resolver los mismos, el informe jurídico desarrolla dos apartados. En el primero,
se analiza la admisión de la prueba prohibida frente al derecho al secreto y la inviolabilidad
de las comunicaciones y al principio de buena administración y la lucha contra la corrupción
para concluir que las intercepciones telefónicas obtenidas con vulneración del derecho
fundamental al secreto y la inviolabilidad de las comunicaciones debieron ser admitidas,
basándonos en la excepción de ponderación de intereses. En el segundo, se analiza el rol de
los medios de comunicación y la lucha contra la corrupción, para concluir que el Tribunal no
podía establecer una suerte de censura previa ni sanción penal por la divulgación o difusión
de las conversaciones interceptadas y grabadas. Por último, la metodología empleada para
realizar el análisis de la resolución fue la revisión de los principios constitucionales, la
normativa nacional e internacional y los conceptos dogmáticos y jurisprudenciales sobre
prueba prohibida.
The purpose of this legal report is to carry out an analysis of the legal problems found in the Judgment of the Constitutional Court Exp. No. 00655-2010-PHC / TC, which establishes that the telephone interceptions carried out on Alberto Quimper constituted prohibited evidence and that the The media were prohibited from disclosing or broadcasting wiretaps and recordings of telephone conversations, without prior authorization. In this sense, to understand the problems raised and solve them, the legal report is divided into two chapters. In the first chapter, the admission of the prohibited test against the right to secrecy and the inviolability of communications and the principle of the fight against corruption is analyzed to conclude that the telephone interceptions obtained in violation of the fundamental right to secrecy and the inviolability of the communications had to be admitted, based on the exception of weighting of interests. In the second chapter, the role of the media and the fight against corruption is analyzed, to conclude that the Court could not establish a kind of prior censorship or criminal sanction for the disclosure or dissemination of the intercepted and recorded conversations. Finally, the methodology used to carry out the analysis of the resolution was the review of constitutional principles, national and international regulations, and dogmatic and jurisprudential concepts on prohibited evidence.
