Abstract
En la actualidad la Inteligencia Artificial se encuentra cada vez más presente en
la vida de las personas. La intersección entre esta y distintas áreas del Derecho
es innegable. Sin embargo, su relación con el área de los Derechos de Autor
cobra especial relevancia para el Derecho Internacional. Ello debido a su
carácter transfronterizo. El presente informe aborda el tema la protección, de
Derechos de Autor, de obras realizadas con Inteligencia Artificial desde el
derecho internacional y analiza una situación que, probablemente, que se
encuentra en pleno debate interpretativo por falta de adecuación normativa.
Para ello, analizamos si el derecho internacional y comparado permite reconocer
la protección de obras creadas por Inteligencia Artificial, no sin antes saber cómo
interpretan los sujetos de derecho internacional, el concepto de ‘‘autoría’’ y qué
entienden por ‘‘nivel de intervención humana suficiente’’. Asimismo, analizamos
uno de los primeros casos sobre el tema, el caso Thaler v. Perlmutter, a la luz de
lo interpretado por el derecho internacional y comparado en el contexto actual.
Finalmente, con el informe pretendemos estudiar los niveles de intervención
humana existentes en la nueva forma de crear que ha generado la participación
de sistemas de Inteligencia Artificial en los Derechos de Autor y su impacto en el
derecho internacional.
Artificial Intelligence is currently growing increasingly present in people's lives. The intersection between AI and different areas of law is undeniable. However, its relationship with the area of copyright is particularly relevant to international law. This is due to its cross-border nature. This report addresses the issue of copyright protection for works created with artificial intelligence from the perspective of international law. It analyzes a situation that is likely to be the subject of intense debate due to a lack of adequate regulations. To this end, we analyze whether international and comparative law allows for the recognition of the protection of works created by Artificial Intelligence, but not before understanding how subjects of international law interpret the concept of “authorship” and what they understand by “sufficient level of human intervention.” We also analyze one of the first cases on the subject, Thaler v. Perlmutter, in light of how it is interpreted by international and comparative law in the current context. Finally, with this report, we aim to study the levels of human intervention that exist in the new form of creation that has generated the participation of Artificial Intelligence systems in copyright and its impact on international law.
