Resumen
El análisis del presente informe analiza la Sentencia N° 1087/2020 del Tribunal
Constitucional (TC) del Perú recaída en el expediente N° 03150-2017-PA/TC,
sobre la demanda de amparo interpuesta por Domingo García Belaúnde, quien
solicitó la inaplicación del impedimento para contratar con el Estado contenido
en el inciso f) del artículo 10 del DL N° 1017, hoy impedimento contemplado en
el punto (i) del inciso h) del artículo 11.1 de la Ley N° 30225.
El argumento central se basó en que el citado impedimento representaba una
amenaza contra su derecho a la libertad de contratación, ya que impedía que
este pueda participar de los procesos de contratación pública por ser pariente en
segundo grado del Congresista de la República, Victor Andrés García Belaúnde.
El caso en concreto generó un debate en el Pleno del TC que llevó a que se
declarara fundada la demanda, pero con varios votos singulares. En ese sentido,
la sentencia analizó el ámbito de aplicación de impedimento, su proporcionalidad
o desproporcionalidad frente al derecho de libertad de contratación y si debido a
todos los cambios normativos se había producido una situación de sustracción
de la materia.
The analysis of this report examines Judgment N° 1087/2020 of the Constitutional Court of Peru in case N° 03150-2017-PA/TC, concerning the writ of amparo filed by Domingo García Belaúnde. He sought the inapplicability of the impediment contained in Article 10, paragraph f) of Legislative Decree N° 1017, now stipulated as impediment (i) of Article 11.1, section h) of Law N° 30225. The central argument was that the mentioned impediment posed a threat to his right to freedom of contract, as it prevented him from participating in public procurement processes due to being a first-degree relative of Congressman Víctor Andrés García Belaúnde. This specific case sparked a debate within the full session of the Constitutional Court, leading to the ruling in favor of the petition but with several dissenting opinions. The judgment analyzed the scope of application of the impediment, its proportionality or disproportionality against the right to freedom of contract, as well as whether the legislative changes had led to a situation of mootness.
