Abstract
El servicio de transporte aéreo de pasajeros en el Perú constituye una actividad de interés general que requiere una especial promoción del Estado. En su momento, la creación de la empresa estatal Tans (1963-2006) significó la preocupación del Estado por promover el acceso al mencionado servicio; sin embargo, tiempo después, la referida empresa fue disuelta y liquidada, entre otros motivos, por operar vuelos comerciales satisfechos por oferta privada.
El fin de la empresa estatal Tans se debió principalmente a que, según el régimen económico previsto en la Constitución del Perú (1993), el Estado no puede realizar actividad empresarial donde existe participación del sector privado. Teniendo en cuenta ello, la actuación del Estado peruano en los últimos años ha estado dirigida a la realización de vuelos de acción cívica y a la implementación de un programa de fomento para la prestación del servicio de transporte aéreo en zonas alejadas del país.
El presente trabajo identifica una actuación estatal referida a la realización de vuelos de acción cívica a zonas donde existe participación del sector privado, hecho que configura una transformación del rol del Estado. Por tal motivo, se propone el rol subsidiario del Estado como garantía del desarrollo de la actividad bajo estudio y se recomienda la modificación de la ley que autoriza la realización de vuelos de acción cívica en el Perú.
The passenger air transport service in Peru is an activity of general interest that requires a special promotion of the State. At the time, the creation of the state company Tans (1963-2006) meant the State's concern to promote access to the aforementioned service; However, some time later, the aforementioned company was dissolved and liquidated, among other reasons, for operating commercial flights satisfied by private offer. The end of the state company Tans was mainly due to the fact that, according to the economic regime provided for in the Constitution of Peru (1993), the State can not carry out business activity where there is participation of the private sector. Taking this into account, the performance of the Peruvian State in recent years has been directed to the realization of civic action flights and to the implementation of a promotion program for the provision of air transport service in remote areas of the country. The present work identifies a state action referred to the performance of civic action flights to areas where there is participation of the private sector, a fact that configures a transformation of the role of the State. For this reason, it proposes the subsidiary role of the State as a guarantee of the development of the activity under study and recommends the modification of law that authorizes the realization of civic action flights in Peru.
