El impedimento para contratar con el Estado por razón de parentesco con altos funcionarios públicos

En el marco de la normativa de contratación pública, en particular desde la emisión del
Decreto Legislativo N° 1017 hasta la recopilación en el actual Texto Único Ordenado
de la Ley N° 30225, el legislador estimó pertinente incluir en el apartado referido a los
impedimentos para contratar con el Estado, uno relacionado a los cónyuges,
convivientes o parientes, entre otros, de funcionarios que ocupan “altos” cargos
públicos, y ello en virtud a determinados grados de consanguinidad o afinidad.
Quizás por temas relacionados a prevenir conflictos de intereses, evitar actos de
corrupción o prácticas indebidas (favoritísimos), o tal vez por mera conveniencia
administrativa, el legislador considera que el impedimento en cuestión debe permanecer
en la normativa aplicable.
En ese sentido, el presente trabajo de investigación tiene por objetivo general el analizar
la controversia de extender una prohibición –impedimento– para contratar con el Estado
a personas naturales que tienen un vínculo de parentesco con “altos” funcionarios
públicos, pero sobre todo que dicha medida tenga un alcance nacional (impedimento
absoluto), se encuentre vigente durante todo el tiempo en que se ejerzan dichos cargos, e
incluso hasta doce (12) meses después de que se hayan dejado los mismos
(impedimento de larga duración).
Cabe indicar que la disposición adoptada resulta ser irracional y desproporcionada, así
como atentatoria de derechos fundamentales, e incluso de principios que rigen la misma
contratación pública.
Así las cosas, se advertirá que existen otras alternativas viables que se encuentran
alineadas al marco normativo de la contratación pública, y que pueden coadyuvar en la
prevención de la problemática advertida por el legislador.
Within the framework of public procurement regulations, in particular from the issuance of Legislative Decree N° 1017 until the compilation in the current Single Ordered Text of Law N° 30225, the legislator considered it pertinent to include in the section referring to the impediments to contract with the State, one related to spouses, partners or relatives, among others, of officials who occupy "high" public positions, and this by virtue of certain degrees of consanguinity or affinity. Perhaps due to issues related to preventing conflicts of interest, avoiding acts of corruption or improper practices (highly favored), or perhaps for mere administrative convenience, the legislator considers that this impediment should remain in the applicable regulation. In this sense, the present research work has the general objective of analyzing the controversy of extending a prohibition –impediment– to contract with the State to persons who have a kinship bond with "high" public officials, but above all that the measure has a national scope (absolute impediment), is in force during the entire time in which the said positions are held, and even up to twelve (12) months after they have been left (long-term impediment). It should be noted that the provision adopted turns out to be irrational and disproportionate, as well as violating fundamental rights, and even the principles that govern public procurement itself. Thus, it will be noted that there are other viable alternatives that are aligned with the regulatory framework of public procurement, and that can contribute to the prevention of the problem that has been warned by the legislator.
