Abstract
El objetivo general del presente trabajo es analizar los aspectos jurídicamente
relevantes de la Resolución 2135-2012/SC2-INDECOPI; en el cual se aborda la
resolución, en segunda instancia administrativa, de un caso vinculado a la
discriminación en el consumo de una persona con síndrome de Down por parte de una
compañía de seguros, en el marco de la solicitud de afiliación por parte de la primera a
un seguro de salud ofrecido por esta última.
Para llevar a cabo el análisis de la referida resolución, se ha empleado un método
descriptivo y deductivo crítico de las principales instituciones jurídicas y preceptos
normativos involucrados en el caso y su aplicación; valiéndonos también de la inclusión
de antecedentes jurisprudenciales sobre la materia.
Tras la aplicación de dicha metodología de trabajo, hemos llegado a dos conclusiones
principalmente. La primera de ellas es que el trato diferenciado dispensado por la
denunciada está desprovisto de razones objetivas y razonables; mientras que la
segunda, que dicho trato diferenciado constituye un acto de discriminación en el
consumo tipificado como una infracción normativa de naturaleza administrativa y
proscrita por la Constitución.
The general objective of this paper is to analyze the legally relevant aspects of the Resolution 2135-2012/SC2-INDECOPI; in which the Tribunal of Defense of Competition, as a court of appeal, resolves a case involving discrimination against a person with Down syndrome by an insurance company in a consumer relationship. In order to carry out the analysis of the aforementioned resolution, we have used a descriptive and deductive critical method of the main legal categories and regulation involved in the case and its application; including legal precedents relevant to the case. After applying this methodology, we have reached two main conclusions. The first one is that the disparate treatment performed by the defendant is devoid of objective and reasonable reasons; while the second one is that such differential treatment constitutes an act of consumer discrimination, typified as a regulatory infringement of an administrative nature, outlawed by the Constitution.
