Resumen
El estudio aborda la disputa legal entre la Asociación Peruana de Consumidores
y Usuarios (ASPEC) y la cadena de cines Cinemark, focalizándose en la política
de esta última que prohíbe la entrada de alimentos externos a sus salas de cine.
ASPEC sostiene que dicha política constituye una cláusula abusiva,
restringiendo la libertad de elección de los consumidores y elevando los costos
injustificadamente, forzándolos a adquirir alimentos a precios excesivos dentro
del cine.
En respaldo a esta denuncia, INDECOPI, mediante la Resolución N.º 0243-
2018/SPC-INDECOPI, sancionó a Cinemark por contravenir el artículo 50, literal
e, del Código de Protección y Defensa del Consumidor. La resolución estableció
que la prohibición impuesta por Cinemark vulneró los derechos de los
consumidores, impidiéndoles ingresar con alimentos adquiridos fuera del
establecimiento.
El análisis concluye que la política de Cinemark limita injustamente la libertad de
elección de los consumidores y afecta negativamente la competencia en el
mercado de alimentos. La investigación subraya la importancia de regular estas
prácticas para asegurar un entorno de consumo justo y equitativo, protegiendo
los derechos de los consumidores. Este caso sienta un precedente significativo
en Perú para la eliminación de cláusulas abusivas en las relaciones de consumo,
resaltando la necesidad de un marco regulatorio que equilibre la libertad
empresarial con la justicia social.

The study addresses the legal dispute between the Peruvian Association of Consumers and Users (ASPEC) and the Cinemark movie theater chain, focusing on the latter's policy that prohibits external food from entering its theaters.
