Resumen
El presente caso se trata sobre un recurso de casación interpuesto ante la Sala Civil
Transitoria de la Corte Suprema de Justicia de la República, donde se analiza la figura
de la carga de la prueba en un proceso de contradicción de revocación a la donación.
A partir de la Resolución Ejecutoria Suprema S/N de fecha 26 de octubre de 2015,
emitida por la Sala Civil Transitoria de la Corte Suprema de Justicia de la República en
el Expediente en Casación N° 01532-2015-0-5001-SU-CI-01, surgen diferentes
interrogantes. Una de ellas es sobre la figura de la carga de la prueba en un proceso
judicial y su aplicación como regla subsidiaria en un proceso. Asimismo, otra
interrogante se ve referida a la posibilidad de aplicar la carga dinámica de la prueba en
el presente caso y su regulación en nuestro ordenamiento jurídico. Finalmente, se suma
como tercer interrogante el contenido de lo que se conoce como prueba diabólica.
Debido a ello, en el presente informe jurídico se realiza un análisis jurídico, en base a
doctrina y jurisprudencia, con la finalidad de dar una respuesta que permita entender
cómo es que se rigen las figuras de la carga de la prueba y la carga dinámica de la
prueba en nuestro ordenamiento y, sobre todo, en un proceso de contradicción a la
revocación de donación.
The present case deals with a cassation appeal filed before the Transitory Civil Chamber of the Supreme Court of Justice of the Republic, where the figure of the burden of proof in a process of contradiction of revocation to the donation is analyzed. From the Supreme Executory Resolution S/N dated October 26, 2015, issued by the Transitory Civil Chamber of the Supreme Court of Justice of the Republic in the Case File in Cassation N° 01532-2015-0-5001-SU-CI-01, different questions arise. One of them is about the figure of the burden of proof in a judicial process and its application as a subsidiary rule in a process. Likewise, another question refers to the possibility of applying the dynamic burden of proof in the present case and its regulation in our legal system. Finally, the third question is the content of what is known as diabolical evidence. Therefore, in the present legal report an analysis is made, based on doctrine and jurisprudence, in order to provide an answer that permits to understand how the figures of the burden of proof and the dynamic burden of proof are governed in our legal system and how they are applied. and, above all, in a proceeding dealing with the contradiction to the revocation of a donation.
