Análisis de impacto regulatorio de la creación del Registro Nacional de Equipos Terminales Móviles para la Seguridad en el Perú

Abstract
En los últimos años se evidencia un incremento considerable en la tasa de incidencia de
robos en el Perú, específicamente, el desarrollo del mercado de telefonía móvil ha generado
que prácticamente todos los transeúntes sean una potencial víctima del robo de sus
pertenencias. Es en ese escenario que el Estado, aprobó el Decreto Legislativo que crea el
Registro Nacional de Equipos Terminales Móviles para la Seguridad, Orientado a la
Prevención y Combate del Comercio Ilegal de Equipos Terminales (RENTESEG) y su
Reglamento. La finalidad de este Decreto es coadyuvar a fortalecer la seguridad ciudadana,
desincentivando la comercialización de equipos terminales móviles de dudosa procedencia.
Desde hace años atrás, la Organization for Economic Co-operation and Development
(OCDE) ha promovido que cada una de las medidas normativas adoptadas por los países
miembros se realice en un análisis de calidad regulatoria, instaurando lineamientos que
permitan evaluarlas adecuadamente. Es en ese marco que, resulta importante analizar
mediante herramientas de calidad regulatoria si el Decreto Legislativo y su Reglamento,
que contienen un conjunto de medidas, son acciones efectivas para el objetivo trazado por
el Estado Peruano.
En ese sentido, el presente estudio desarrolla el marco teórico donde se espera describir
de forma detallada el rol de las telecomunicaciones en la seguridad ciudadana, así como
las medidas adoptadas a la fecha con la finalidad de combatir el uso de estos servicios con
fines delictivos. Asimismo, se detallarán los Lineamientos de Análisis de Impacto
Regulatorio que utiliza la OCDE. Luego se analizará las medidas similares que se han
adoptado en otros países, con la finalidad de contar con un marco de referencia de casos
similares. Por último, se realizará un Análisis de Impacto Regulatorio para las principales
medidas que contiene el Decreto Legislativo y su Reglamento, para así poder evaluar si
alguna de estas medidas carece de un adecuado análisis de calidad regulatoria.
In recent years there is evidence of a significant increase in the incidence of theft in Peru, specifically, the development of the mobile telephony market has generated that virtually all passersby are a potential victim of theft of their belongings. In this context the State approved the Legislative Decree that creates the National Registry of Mobile Terminal Equipment for Security, oriented towards the Prevention and Combat of Illegal Trade of Terminal Equipment (RENTESEG) and its Regulation. The purpose of this Decree is to contribute to citizen security, discourage the commercialization of portable equipment of dubious origin. Since many years ago, the Organization for Economic Co-operation and Development (OECD) has promoted that each of policy measures adopted by members countries be carried out in an analysis of regulatory quality, for adequate evaluation. It is in this framework that, it is important to analyze through regulatory quality tools if the Legislative Decree and its Regulation, which contains a set of measures, are effective actions for the purpose outlined by the Peruvian State. In this sense, this study develop the theoretical framework in which it is expected that the role of telecommunications in citizen security are going to be described in detail, as well as the measures adopted to date in order to combat the use of these services for criminal purposes. Likewise, the Guidelines for Analysis of Regulatory Impact used by the OECD are going to be detailed. Then we are going to see the measures that have been adopted in other countries, to have a frame of reference for similar cases. Finally, an analysis of Regulatory Impact was carried out for the main measures contained in the Legislative Decree and its Regulations, in order to evaluate, if some measures lack an adequate analysis of regulatory quality.
