Resumen
La resolución materia de análisis versa sobre un caso de discriminación por
identidad sexual ocurrido en el año 2012 teniendo como partes del caso a Gothic
Entertainment S.A. (en adelante Discoteca Gótica) y Godfrey Arbulú Grippa (en
adelante Srta. Arbulú). La Sala Especializada en Protección al Consumidor
reconoce la ocurrencia de un acto discriminatorio en el consumo realizado por la
Discoteca Gótica contra la Srta. Arbulú esto por su condición de persona
transexual. La finalidad del trabajo es analizar I) que es la discriminación y su
aplicación al caso en concreto, II) el deber de información respecto a la
injustificada elevación del precio de la entrada a la Discoteca Gótica
Es imperativo mencionar que la Sala Especializada en Protección al Consumidor
no pudo realizar un adecuado manejo de los conceptos inmersos en este caso,
así como no tampoco logró identificar correctamente la acción discriminatoria
para un análisis idóneo. Por lo cual, mediante el uso de doctrina nacional e
internacional, tanto jurídica como interdisciplinaria, se demostrará la necesidad
de entender lo que identifica al grupo de personas que puede ser víctima de un
acto discriminatorio como lo es la comunidad trans.
El derecho a la no discriminación es un derecho fundamental vinculado
directamente al derecho a la dignidad y reconocido como parte de los derechos
humanos; no se busca únicamente evaluar el caso en específico, sino resolver
la situación de discriminación a la cual puede ser víctima no solo la Srta. Arbulú,
sino cualquier otra persona que forma parte de este grupo humano
históricamente vulnerado.
The decision under analysis deals with a case of discrimination based on sexual identity that occurred in 2012, with Gothic Entertainment S.A. (hereinafter Discoteca Gótica) and Godfrey Arbulú Grippa (hereinafter Ms. Arbulú) as parties to the case. The Specialised Chamber on Consumer Protection recognises the occurrence of a discriminatory act in the consumption carried out by Gothic Discotheque against Miss Arbulú because of her condition as a transsexual person. The purpose of this paper is to analyse I) what discrimination is and its application to the specific case, II) the duty of information regarding the unjustified increase in the price of admission to the Discoteca Gótica, and III) the duty of information regarding the unjustified increase in the price of admission to the Discoteca Gótica. It is imperative to mention that the Specialised Consumer Protection Court was not able to adequately handle the concepts involved in this case, nor was it able to correctly identify the discriminatory action for a suitable analysis. Therefore, through the use of national and international doctrine, both legal and interdisciplinary, it will demonstrate the need to understand what identifies the group of people who may be victims of a discriminatory act, such as the transgender community. The right to non-discrimination is a fundamental right directly linked to the right to dignity and recognised as part of human rights; the aim is not only to evaluate the specific case, but to resolve the situation of discrimination to which not only Ms. Arbulú, but any other person who is part of this historically vulnerable human group, may be a victim.
