Resumen
El presente Informe realiza el análisis de la Sentencia de Casación N° 231-2017
Puno emitido por la Corte Suprema de Justicia del Perú. Esta sentencia
evidencia una disociación en dos ámbitos de la Administración Pública. Así, por
un lado, analizamos el estándar de actuación que debieron tener los funcionarios
públicos de la Municipalidad de Melgar desde los principios de buen gobierno y
buena administración para una correcta toma de decisiones durante el ciclo de
las contrataciones públicas. Por otro lado, desarrollamos cómo la función judicial
debe ir acorde con el principio de corrección en el marco de un buen gobierno,
toda vez que la decisión emitida por la Sala Suprema resulta cuestionable
respecto a la errónea interpretación que realiza sobre los elementos y tipificación
del delito de negociación incompatible establecido en el artículo 399 del Código
Penal.
En ese sentido, para el análisis se ha empleado normativa nacional, instrumentos
internacionales como las Convenciones de lucha contra la corrupción, códigos
de conducta, doctrina y jurisprudencia aplicable. Ello, a fin de determinar que los
funcionarios públicos de la Municipalidad de Melgar, así como los operadores de
justicia deben orientar su actuación bajo los principios del buen gobierno, puesto
que brindan calidad en la correcta toma de decisiones.
The present Report conducts an analysis of Supreme Court Judgment No. 231- 2017 Puno issued by the Supreme Court of Justice of Peru. This judgment reveals a dissociation in two areas of Public Administration. Thus, on one hand, we analyze the standard of conduct that the public officials of the Municipality of Melgar should have adhered to based on the principles of good governance and sound administration for correct decision-making during the public procurement cycle. On the other hand, we develop how the judicial function must align with the principle of properness within the framework of good governance, given that the decision issued by the Supreme Chamber is questionable regarding its erroneous interpretation of the elements and classification of the crime of incompatible negotiation as established in Article 399 of the Penal Code. In this regard, the analysis has employed national regulations, international instruments such as anti-corruption conventions, codes of conduct, applicable doctrine, and jurisprudence. This is to determine that the public officials of the Municipality of Melgar, as well as the judicial operators, must guide their actions under the principles of good governance, as these provide quality in proper decision-making.
