Resumen
En el presente informe jurídico se analiza los límites y alcances que puede tener
un registrador público al momento ejercer su función calificadora de documentos
conformados por partes notariales de testamento y ampliación de testamento.
Ello debido a que en la Resolución Nº388-2005-SUNARP-TR-L, en primera
instancia, el registrador observó el parte notarial de la solicitud de inscripción de
testamento y su ampliación, pues se había preterido a los herederos forzosos,
siendo este una causal de anulabilidad establecido en el artículo 806 del Código
Civil en concordancia con el artículo 221 inciso 4 del mismo cuerpo normativo.
Sin embargo, a raíz de ello, la discusión versa en que si es o no posible que un
registrador califique la validez del contenido de un documento notarial
testamentario. Para ello, se estableció, en el primer capítulo, un marco teórico
que tiene por finalidad definir los aspectos más relevantes del caso; y en los
siguientes capítulos se realizó el análisis de los problemas jurídicos, donde
finalmente se determinó que no es posible que un registrador público pueda
calificar la validez de documentos notariales por escritura pública, debido a que
los únicos que pueden cuestionar la validez del contenido del parte notarial son
los herederos forzosos preteridos
In this legal report, the limits and scope of a public registrar may have when exercising their qualifying function of documents consisting of notarial parts of a will and its amendment are analyzed. This is due to the fact that in Resolution Nº 388-2005-SUNARP-TR-L, initially, the registrar objected to the notarial part of the application for the registration of the will and its amendment, as it had omitted the forced heirs, which is a cause for annulment established in in article 806 of the Civil Code In conjunction with article 221, section 4, of the same legal norm. However, as a result of this, the discussion revolves around whether it is possible for registrar to assess the validity of the content of testamentary notarial document. To explain that, the first chapter provides a theoretical framework aimed at defining the most relevant aspects of the case. The following then analyzed the legal issues. Finally, it was concluded that is not possible for a public registrar to assess the validity of notarial documents by public deed since only the omitted forced heirs have the right to question the validity of the content of the notarial part
