Análisis comparativo entre la protección jurisprudencial constitucional del derecho a morir dignamente en Perú y Colombia

Abstract

En el presente artículo de investigación buscamos analizar el desarrollo jurídico jurisprudencial del derecho a morir dignamente en Perú y Colombia. Asimismo, desde un estudio comparado, entre ambos países, pretendemos determinar las similitudes y diferencias que existen entre ambas. De esta manera, el artículo se orientará, primero, a aproximarnos a qué es el derecho a morir dignamente, las maneras de efectivizar y cuáles serían los elementos básicos frente a una regulación de este derecho. Segundo, procederemos a analizar el desarrollo y tratamiento jurisprudencial constitucional del derecho a morir dignamente en ambos países. Finalmente, determinaremos cuáles son las diferencias y similitudes que se encuentran entre estos dos países luego del análisis realizado previamente.

In this research article we seek to analyze the jurisprudential legal development of the right to die with dignity in Peru and Colombia. Likewise, from a comparative study, between both countries, we intend to determine the similarities and differences that exist between them. In this way, the article will be oriented, first, to approach what is the right to die with dignity, the ways to make it effective and what would be the basic elements of a regulation of this right. Second, we will proceed to analyze the development and constitutional jurisprudential treatment of the right to die with dignity in both countries. Finally, we will determine the differences and similarities between these two countries after the previous analysis.
