Abstract
El presente artículo versa sobre la inexistencia de la perspectiva de género
dentro del sistema penal peruano como una transgresión al principio de igualdad y no
discriminación, el mismo que se enfoca en dos problemas específicos. El primero
indaga sobre cómo la deconstrucción de estereotipos de género impacta la
administración de justicia, particularmente en la valoración de casos penales, para
ello examina la ausencia de este enfoque en los operadores de justicia y su influencia
en el acceso a la justicia para víctimas de violencia de género.
El segundo problema se centra en el rol de los jueces penales en casos de
violencia contra la mujer, por lo que analiza la evolución del Estado Constitucional y
el papel del juez en un contexto democrático. Además, explora las diferencias entre
neutralidad e imparcialidad y su aplicación en casos de Violencia Basada en Género
(VBG), así como la relevancia del enfoque de género en el ámbito procesal de estos
casos y su impacto en la justicia.
En tanto, el presente artículo analiza la importancia de deconstruir los
estereotipos de género en la valoración de casos penales, así como el rol y la
evolución del Estado Constitucional en relación con la actuación de los jueces penales
en casos de violencia contra la mujer.
This article deals with the nonexistence of the gender perspective within the Peruvian penal system as a transgression of the principle of equality and nondiscrimination, which focuses on two specific problems. The first investigates how the deconstruction of gender stereotypes impacts the administration of justice, particularly in the assessment of criminal cases, to do so it examines the absence of this approach in justice operators and its influence on access to justice for victims of crime. gender violence.
