Abstract
El presente artículo tiene el objetivo analizar el estándar de (des)protección en
el que incurre la Ley N°31096, “Ley que precisa los alcances de la Ley 28972,
Ley que establece la formalización del transporte terrestre de pasajeros en
automóviles colectivos” sobre el derecho a la movilidad sostenible de los
usuarios del transporte público en el Perú, una facultad que aún no es reconocida
explícitamente en nuestro país pero que merece especial atención al estar
vinculado con derechos fundamentales para el desarrollo de las personas.
El tema planteado presenta relevancia jurídica en tanto, dentro de los votos
singulares o el voto en bloque del Tribunal Constitucional al decidir sobre el caso
de los automóviles colectivos, se debió desarrollar el vicio material respecto a la
vulneración del derecho a la movilidad sostenible de los usuarios, lo cual hubiera
permitido tener más argumentos a favor de la inconstitucionalidad de la Ley
N°31096. Para ello, en primer lugar, se introducirá a los lectores en los aspectos
claves para el análisis de la norma en cuestión. En segundo lugar, se analizará
el vicio material respecto de la vulneración del derecho a la movilidad sostenible
de la Ley N°31096. En tercer lugar, se expondrán conclusiones y
recomendaciones a partir del análisis realizado.
The purpose of this article is to analyze the standard of (dis)protection incurred by Law N°31096, "Law that specifies the scope of Law 28972, Law that establishes the formalization of land transportation of passengers in collective automobiles" on the right to sustainable mobility of public transportation users in Peru, a right that is not yet explicitly recognized in our country but deserves special attention as it is linked to fundamental rights for the development of people. The issue raised presents legal relevance in that, within the singular votes or the block vote of the Constitutional Court when deciding on the case of collective automobiles, the material defect regarding the violation of the sustainable mobility right of the users should have been developed, which would have allowed for more arguments in favor of the unconstitutionality of Law No. 31096. To this end, first, readers will be introduced to the key aspects for the analysis of the law in question. Secondly, I will analyze the material defect regarding the violation of the right to sustainable mobility of Law No. 31096. Thirdly, I will propose conclusions and recommendations based on the analysis.
