Resumen
El presente informe pretende profundizar en el análisis jurídico aplicable a las denuncias
contra entidades financieras ante INDECOPI, por operaciones no reconocidas con cargo
a una tarjeta de crédito o débito. En ese sentido, el análisis se desarrolla sobre la base del
expediente 2272-2018/SPC-INDECOPI, a través del cual se identificarán todas las
obligaciones que las entidades financieras deben adoptar en el procesamiento de
operaciones realizadas mediante el uso de una tarjeta de débito o crédito y, a su vez,
identificar aquellos supuestos de infracción en los que dichas entidades incurren cuando
no cumplen con tales exigencias.
La problemática a tratar resulta útil, interesante e importante, en la medida que nos
permite conocer cuál es el enfoque apropiado para el análisis que la Autoridad debería
realizar en todos aquellos casos en los que se cuestionen retiros de efectivo no
reconocidos, es decir, un enfoque en cuyo análisis se verifique una correcta imputación
de cargos, así como el cumplimiento de cada una de las obligaciones legales que poseen
las entidades financieras, en lo que respecta a las medidas de seguridad exigibles al Banco
en el procesamiento de retiros de efectivo con cargo a una tarjeta de crédito o débito.
Finalmente, se abordarán los alcances jurídicos respecto de la clonación de tarjetas y sus
implicancias en el análisis de operaciones no reconocidas, cuya importancia recae en la
frecuencia con la que se suele asociar esta modalidad de fraude con el cuestionamiento
de operaciones no reconocidas.
This report aims to deepen the legal analysis applicable to complaints against financial entities before INDECOPI, for unrecognized transactions charged to a credit or debit card. In that sense, the analysis is developed on the basis of file 2272-2018/SPC-INDECOPI, through which all the obligations that financial entities must adopt in the processing of transactions made through the use of a debit or credit card will be identified and, in turn, identify those assumptions of infringement in which such entities incur when they do not comply with such requirements. The problem to be dealt with is useful, interesting and important, to the extent that it allows us to know what is the appropriate approach for the analysis that the Authority should perform in all those cases in which unrecognized cash withdrawals are questioned, that is to say, an approach in whose analysis a correct imputation of charges is verified, as well as the compliance with each of the legal obligations that financial entities have, with respect to the security measures required from the Bank in the processing of cash withdrawals charged to a credit or debit card. Finally, the legal scope of card cloning and its implications in the analysis of unrecognized transactions will be addressed, the importance of which lies in the frequency with which this type of fraud is usually associated with the questioning of unrecognized transactions.
