Resumen
El presente informe jurídico versará sobre el análisis de la Resolución N° 2377-
2021-SUNARP-TR de fecha 05 de noviembre de 2021, mediante el cual se
establece que se requiere se requiere un nuevo informe de verificación emitido
por el verificador responsable para levantar las cargas técnicas impuestas
debido a observaciones en el informe técnico, las cuales supuestamente
infringieron normativas de edificación al usar una normativa técnica no vigente
durante la ejecución de la fábrica objeto de regularización. Asimismo, el tribunal
determinó que las declaraciones del verificador, emitidas bajo su
responsabilidad, se basan en aspectos técnicos que el Registro no debe evaluar.
Determinar si existen violaciones a las normativas urbanísticas o de edificación
es responsabilidad exclusiva de los verificadores, como parte de su función
detallada anteriormente. Además, indicó que el Registro no debe cuestionar las
normativas legales o reglamentarias utilizadas por el verificador para certificar
que los predios cumplen con los parámetros urbanísticos y edificatorios vigentes
al momento de la construcción. En el presente informe se abordarán las
limitaciones que sobre la calificación registral en el caso específico del informe
técnico de verificación expedido por el verificador responsable en el contexto de
la regularización de edificaciones conforme a las disposiciones establecidas en
la Ley 27157.
This legal report will focus on the analysis of Resolution No. 2377-2021- SUNARP-TR dated November 5, 2021, which establishes the requirement for a new verification report issued by the responsible verifier to lift technical burdens imposed due to observations in the technical report, allegedly violating building regulations by using a non-current technical standard during the execution of the factory subject to regularization. Furthermore, the tribunal determined that the verifier's statements, issued under their responsibility, are based on technical aspects that the Registry should not evaluate. Determining whether there are violations of urban planning or building regulations is the exclusive responsibility of verifiers, as part of their detailed function mentioned above. Additionally, it indicated that the Registry should not question the legal or regulatory standards used by the verifier to certify that properties comply with urban planning and building parameters in force at the time of construction. This report will address the limitations on registry qualification specifically concerning the verification technical report issued by the responsible verifier in the context of building regularization under the provisions of Law 27157.
