Resumen
En este informe se aborda la controversia respecto a si resulta aplicable la regla de
subcapitalización a la deducción de intereses devengados en etapa preoperativa, para lo cual
se analiza la Resolución N°04711-4-2020, en la cual el Tribunal Fiscal aborda la referida
controversia. El objetivo de este trabajo es proporcionar una respuesta respecto a si la regla
de subcapitalización resulta o no aplicable a la deducción de intereses devengados en etapa
preoperativa y en caso resultar aplicable, en qué momento debe efectuarse el cálculo para
determinar el monto máximo de intereses deducible, si al momento de incurrir en el
endeudamiento (etapa preoperativa) o al momento de deducir el gasto (etapa operativa). Para
ello, se analiza las disposiciones normativas aplicables recurriendo, adicionalmente, a
doctrina y jurisprudencia sobre la materia.
Se concluye que sí es correcto aplicar la regla de subcapitalización a la deducción de
intereses devengados en etapa preoperativa, para lo cual, el cálculo del monto máximo de
intereses deducible se debe efectuar al momento de generar ingresos (etapa operativa)
teniendo en consideración los fines antielusivos de la regla de subcapitalización, esto es,
evitar que se erosione la base imponible del impuesto mediante la deducción excesiva de
intereses producto de un financiamiento que podría estar encubriendo un aporte de capital.
This report addresses the controversy regarding whether the thin capitalization rule is applicable to the deduction of accrued interest in the pre-operational stage, for which Resolution N°04711-4-2020 is analyzed, in which the Tax Court addresses the aforementioned controversy. The objective of this paper is to provide an answer as to whether or not the thin capitalization rule is applicable to the deduction of accrued interest in the preoperative stage and, if applicable, at what time the calculation should be made to determine the maximum amount of deductible interest, if at the time of incurring the debt (preoperative stage) or at the time of deducting the expense (operative stage). For this, the applicable normative provisions are analyzed, resorting, additionally, to doctrine and jurisprudence on the matter. It is concluded that it is correct to apply the thin capitalization rule to the deduction of accrued interest in the pre-operational stage, for which the calculation of the maximum amount of deductible interest must be made at the time of generating income (operational stage) taking into account the anti-avoidance purposes of the thin capitalization rule, that is, to prevent the tax base from being eroded by excessive deduction of interest resulting from financing that could be concealing a capital contribution.
