Abstract
El presente informe jurídico analiza la Resolución N° 1990-2013-TC-S1, acto
administrativo que deja sin efecto la Resolución N° 1737-2013-TC-S1, siendo
que la resolución carece de los requisitos de validez al evidenciarse
contradicción en la motivación y vulneración a la finalidad publica, en medida que
se quebranta los artículo 61, 62 y 73 de la Constitución Política del Perú de 1993,
que salvaguardan la Libertad de Contratación y Libertad de Competencia en los
procesos de adjudicación que requieren recursos públicos del Estado. Así, como
vamos a evidencia que se transgrede el principio de legalidad, conducta
procedimental e imparcialidad contemplados en la Ley de procedimiento
Administrativo General vigente.
This legal report analyzes Resolution No. 1990-2013-TC-S1, administrative act that leaves without effect Resolution N° 1737-2013-TC-S1, being that the resolution lacks the requirements of validity by evidencing contradiction in the motivation and violation of the public purpose, to the extent that it violates Articles 61, 62 and 73 of the Political Constitution of Peru of 1993, which safeguard the Freedom of Contracting and Freedom of Competition in the awarding processes that require public resources of the state. Thus, as we are going to evidence that the principle of legality, procedural conduct and impartiality contemplated in the General Administrative Procedure Law in force is transgressed.
