Resumen
El presente informe jurídico aborda el proceso de inconstitucionalidad de los Decretos
Legislativos N° 982, N° 983, N° 988 y N° 989 emitidos a consecuencia de la Ley
autoritativa N° 29009 -Ley que otorga al Poder Ejecutivo facultades para legislar en
materia de tráfico ilícito de drogas, lavado de activos, terrorismo, secuestro, extorsión,
crimen organizado, trata de personas y pandillaje pernicioso. Con el objetivo de
determinar la validez o invalidez constitucional de la normativa delegada, se examina
la delegación de facultades de carácter legislativo otorgadas al presidente de la
República, además de desarrollar los tipos de controles posteriores a los que se
encuentra sometida y se analiza las infracciones de forma y fondo alegadas.
Aproximación dogmática que se realiza por medio de la interpretación jurídica,
sistemática, así como teleológica para resaltar la finalidad constitucional aplicando
conocimientos vinculados al derecho penal. Con el propósito de probar que en su voto
en mayoría el Tribunal Constitucional ha omitido el cumplimiento de su función de
garantizar la supremacía de la Carta fundamental, así como el Pleno en su generalidad
de pronunciarse en cuestiones de fondo. Razón por la cual se concluye que no se ha
efectuado un correcto control de constitucionalidad.
This legal report addresses the process of unconstitutionality of Legislative Decrees N° 982, N° 983, N° 988 and N° 989 issued as a result of Authoritative Law N° 29009 - Law that grants the Executive Power powers to legislate on illicit drug trafficking, money laundering, terrorism, kidnapping, extortion, organized crime, human trafficking and pernicious gang. In order to analyze the delegated regulations to determine their constitutional validity or invalidity, delegation of legislative powers to the Republic president is examined, types of subsequent controls to which it is subjected is developed and the alleged formal and substantive infractions are analyzed. Dogmatic approach that is carried out by means of legal, systematic as well as teleological interpretation to highlight in the constitutional purpose by applying knowledge related to criminal law. In order to prove that in its majority vote Constitutional Court has omitted their fulfillment of its function of guaranteeing the supremacy of our Fundamental Charter, also the Plenary in its generality to pronounce on substantive matters. That is why it is concluded that a correct control of constitutionality has not been carried out.
