Abstract

El informe desarrolla la implicancia del nexo causal dentro de la determinación de la responsabilidad en un accidente de trabajo, ello en base al análisis de un caso específico desde dos perspectivas; por un lado, por la Superintendencia Nacional de Fiscalización Laboral, quien concluye el procedimiento con la imputación de la responsabilidad la empresa; y, por otro lado, en sede judicial, se establece la inexistencia de la relación de causalidad, concluyéndose la ausencia de responsabilidad. A raíz de esta contradicción, resultará necesario analizar si efectivamente se realizó el análisis de la responsabilidad de manera correcta en la fase inspectiva; asimismo, se evaluará si es que la ruptura del nexo causal con respecto a la falta imputada exime de responsabilidad al empleador o si este siempre debe asumirla en base al tipo de responsabilidad que desarrolla nuestra legislación y la aplicación que realizan los servidores. Una vez desarrollado ese análisis, se determinará la incidencia de la aplicación del principio de razonabilidad durante el procedimiento inspectivo, a fin de verificar si se cumplen con los requisitos del mismo y el principio de proporcionalidad durante la imposición de una sanción administrativa vinculado al desarrollo del caso y la finalidad de todo el procedimiento.
