Análisis de la obtención sostenible de la licencia social en la minería en el Perú: Los casos de Antamina y Santa Ana

Resumen
El presente trabajo de investigación busca determinar si la intervención
articulada entre el Estado, la empresa y las comunidades fomentará el
otorgamiento efectivo y sostenible de la licencia social para las actividades
minero extractivas; y en consecuencia, se reflejará en la reducción de la
conflictividad social y mejorará las relaciones entre comunidad y empresa
minera. Para ello, la metodología utilizada es cualitativa, basada en el análisis
de los casos de la Compañía Minera Antamina S.A. y el Proyecto Minero Santa
Ana de Bear Creek Mining Company Sucursal del Perú.
Para el desarrollo del trabajo de investigación, se recurrió a literatura
sobre la evolución de la conflictividad social en la minería en el Perú, las
definiciones de licencia social, responsabilidad social empresarial y
autorregulación, con la finalidad de comprender el origen de la conflictividad
social y su relación con el comportamiento empresarial y la intervención estatal.
Además, se considera importante analizar si el establecimiento de políticas
públicas a nivel de lineamientos o normatividad coadyuvará a reducir el índice
de conflictos sociales relacionados a la actividad minera.
Como resultado de la investigación, se tiene la importancia de la
intervención articulada entre el Estado, la empresa y las comunidades y la
autorregulación de las empresas mineras, como mecanismo para obtener una
licencia social sostenible en el tiempo que otorgue la viabilidad a los proyectos
mineros y reduzca la incidencia de conflictividad social.
This research work seeks to determine if the articulated intervention between the State, the company and the communities will promote the effective and sustainable granting of the social license for extractive mining activities and consequently will reflect the reduction of social conflict and improve relations between community and mining company. The methodology used is qualitative, based on the analysis of cases of the Antamina mining unit owned by Antamina Mining Company and Santa Ana Mining Project owned by Bear Creek Mining Company Sucursal del Perú. For the development of the research work, the literature used on was the evolution of social conflict in mining in Peru, the description of social license, corporate social responsibility and self-regulation, in order to understand the origin of social conflict and its relationship with business behavior and state intervention. In addition, it is considered important to analyze whether the establishment of public policies at the level of guidelines or regulations could help reduce the rate of social conflicts related to mining activity. As a result of the investigation, there is the importance of the articulated intervention between the State, the company and the communities; as well as the self-regulation of mining companies, as a mechanism to obtain a sustainable social license over time that grants the viability of mining projects and reduces the incidence of social conflict.
