Análisis crítico sobre la configuración del delito de negociación incompatible a la luz de la línea interpretativa propuesta por la Corte Suprema en la Casación N° 231-2017-Puno

Resumen
El presente informe jurídico tiene como objetivo realizar un análisis crítico sobre los
problemas jurídicos identificados en la Casación N° 231-2017-Puno, a través de la cual, se
absolvió por el delito de negociación incompatible a los acusados -alcalde y miembros del
comité especial de la provincia de Melgar- en referencia a un proceso de contratación bajo la
modalidad de proceso exonerado realizado en el año 2010.
En la sentencia en mención se ha identificado tres problemas jurídicos: el primero, hace
referencia a que el bien jurídico del delito de negociación incompatible es el patrimonio, el
segundo es que en la sentencia se identifica al delito de negociación incompatible como un
delito de peligro concreto y, el tercer problema jurídico identificado es que de acuerdo con la
Corte Suprema, el interés indebido no es una mera parcialización, sino que este interés se
tiene que ver reflejado en un beneficio de carácter económico sobre el propio sujeto activo o
terceros. Al respecto, a lo largo del trabajo, a través de un análisis teórico, jurídico y, además,
normativo se postulará que esta lectura de la Corte Suprema es errada en tanto estas
conclusiones no se derivan de la estructura típica de este delito, así como que la misma no es
acorde con una lectura de proscripción de la corrupción, menos aún, es una línea de
interpretación conforme las Convenciones Internacionales sobre la lucha contra la
corrupción.
The purpose of this legal report is to make a critical analysis of the legal problems identified in Cassation N°. 231-2017-Puno, through which the defendants -mayor and members of the special committee of the province of Melgar- were acquitted for the crime of incompatible negotiation - in reference to a contracting process under the modality of exonerated process carried out in 2010. In this work, have been identified three legal problems in the sentence: the first refers to the fact that the legal asset of the crime of incompatible negotiation is the patrimony, the second is that in the sentence the crime of incompatible negotiation is identified as a crime of specific danger and, the third legal identifying problem is that according to the Supreme Court, the undue interest is not a mere bias, but rather this interest must be reflected in an economic benefit on the active subject or third parties. In this regard, throughout the work, through a theoretical, legal and, in addition, normative analysis, it will postulate that this reading of the Supreme Court is wrong insofar as these conclusions are not derived from the typical structure of this crime, as well as it is not consistent with a reading of the prohibition of corruption, even less, it is a line of interpretation in accordance with the International Conventions on the fight against corruption.
