Resumen
Se sabe que es deber del juzgador emitir sentencia debidamente justificada
que explicite las razones que conlleva adoptar una u otra decisión. Con ese
propósito se ha detectado en el caso de alimentos (sobre todo) se recurre
cotidianamente al uso de las máximas de experiencia, en ese afán; en
principios es nuestro propósito el brindar los diversos significados de “máximas
de experiencia”, tomar postura respecto a una definición y estructura mínima
que permita comprender su identificación en un caso, sus alcances, y sus
efectos.
Luego presentaremos el proceso civil de alimentos como un de tipo altamente
flexible, que permite concretar valores del derecho fundamental a los alimentos
y concretar el interés superior del niño(a) y adolescente. Enseguida
corresponde tener un entendimiento de qué cosa implica justificar una decisión
y finalmente presentar algunos casos, que muestren una forma obtusa de
presentar argumentos para justificar un posible uso de máxima de experiencia.
