Abstract
El Informe que nos ocupa gira en torno al análisis efectuado de la Resolución
N° 7 emitida por la Segunda Sala Comercial Permanente – Corte Superior de Justicia de
Lima, a través de la cual se dispuso la anulación del Laudo Arbitral emitido con fecha 31 de
enero de 2019 en el arbitraje seguido entre REBECA MARÍA GUTIÉRREZ SÁNCHEZ y
PROVÍAS NACIONAL DEL MTC en materia de expropiación, por supuestos vicios en la
motivación del Tribunal Arbitral al momento de emitir el Laudo Arbitral impugnado.
El propósito del presente Informe es analizar los aspectos relacionados a la debida
motivación de las decisiones, la valoración que el Tribunal Arbitral realizó sobre los
dictámenes periciales en el Laudo Arbitral y el control judicial de los laudos arbitrales a la luz
de la doctrina y el Decreto Legislativo N° 1071 – Ley de Arbitraje.
Para tales efectos, tomando como referencia el Decreto Legislativo N° 1192 y su
modificatoria sobre los arbitrajes en materia de expropiación, se determina que el Laudo
Arbitral materia de impugnación incurrió en defectos en la motivación y valoración de la
pericia de oficio dispuesta en dicho proceso arbitral. En consecuencia, tras un análisis de los
fundamentos de la Segunda Sala Comercial Permanente y luego de revisar la doctrina y
jurisprudencia sobre las causales de anulación previstas en nuestro ordenamiento, el autor
emite su postura frente a si procede o no la anulación del Laudo Arbitral en el marco del
artículo 63.1 inciso b) de la Ley de Arbitraje.
This report revolves around the analysis conducted on the Resolution N° 7 issued by the Segunda Sala Comercial Permanente - Corte Superior de Justicia de Lima, in which was agreed the annulment of the Arbitration Award issued on January 31st of 2019 during the arbitration process between REBECA MARÍA GUTIÉRREZ SÁNCHEZ and PROVÍAS NACIONAL DEL MTC in regards to an expropriation process, due to apparent defects in due motivation from the Arbitral Tribunal when issuing the contested Arbitration Award. The objective of this research is to analyze the aspects related to the correct statement of reasons and due motivation behind the decisions, the probationary valuation of the Expert Evidence in the Arbitration Award and the judicial control of the arbitration awards according to doctrine and Legislative Decree N° 1071 - Arbitration Law. In that regard, based on the Legislative Decree N° 1192 and its modifying standards on arbitration processes in matter of expropriation, it is concluded that the contested Arbitration Award incurred in errors in the due motivation and probationary valuation provided in such arbitration process. Because of that and after analyzing the fundamentals issued by the Segunda Sala Comercial Permanente, and analyzing the doctrine and jurisprudence about grounds for annulment of arbitration awards in our legal system, the author takes a stand on whether or not the annulment proceeds according to article 63.1, subsection b) of the Peruvian Arbitration Law.
